Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Ben Davis, Associate Civil Engineer, bdavis@newportbeachca.gov PHONE: 949-644-3317 TITLE: Street Pavement Repair Program — Notice of Completion for Contract No. 7442-1 (19R03) ABSTRACT: On November 13, 2018, City Council awarded Contract No. 7442-1 for the Street Pavement Repair Program to EBS General Engineering, Inc. The work is complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project. On November 13, 2018, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15302(c); b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. FUNDING REQUIREMENTS: Funds for this construction contract were included within the approved Capital Improvement Program and were expended from the following account: Account Description Gas Tax Account Number 12101-980000-19R03 Total: Amount $ 389,545.90 $ 389,545.90 12-1 DISCUSSION: Street Pavement Repair Program — Notice of Completion for Contract No. 7442-1 (19R03) June 11, 2019 Page 2 Overall Contract Cost/Time Summary Awarded Final Cost at Contingency Actual % Due to % Due to Contract Amount Completion Allowance Contract Directed Unforeseen Change Change Change $422,630.00 $389,545.90 10% or less -7.8% -0.9% -6.9% Allowed Contract Time + 61 Actual Time -2 Approved Extensions (days) = Under (-) or Over (+) This project repaired isolated street pavement failures on Jamboree Road, Bayview Way, Von Karman, San Joaquin Hills Road, and Short Street. The contracted work has been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows: Original bid amount: $422,630.00 Actual Cost of Bid Items Constructed: $349,118.40 Total Change Orders: $40,427.50 Final Contract Cost: $389,545.90 The final contract cost was $389,545.90, which was approximately 7.8 percent lower than the original bid amount. This cost decrease was primarily due to eliminating the 1 -inch thick asphalt leveling course. Upon completion of the grinding operation, staff and the contractor determined that the pavement was already relatively level with minor imperfections. As a result, the asphalt leveling course was not necessary and deleted from the work scope. This project included one change order for a total amount of $40,427.50, which was approximately 9.6 percent of the original bid amount. The change order included addressing additional asphalt street patching that was identified during the project on Cliff Drive, East Coast Highway, Jamboree Road and San Joaquin Hills Road. Additionally, as a result of inclement weather during the project, the City added 21 working days to the Contract completion time. A summary of the project schedule milestones is as follows: Estimated Start of Construction per Annual Baseline Schedule 12/3/19 Actual Start of Construction Per Notice to Proceed 2/11/19 Extended Contract Completion Date Inclusive of Extra Work 5/7/19 Actual Substantial Construction Completion Date 5/3/19 12-2 Street Pavement Repair Program — Notice of Completion for Contract No. 7442-1 (19R03) June 11, 2019 Page 3 ENVIRONMENTAL REVIEW: On January November 13, 2018, City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15302(c) Class 2 (reconstruction of existing facility involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
