DATE: September 14, 1981 MINUTES A. 'ROLL CALL. B. The reading of the Minutes of the Meeting of August 24, 1981; and Minutes of the Adjourned Meeting of August 31, 1981, was waived, approved as written and ordered filed. C. The reading of all ordinances and resolutions under consideration was waived, and the City Clerk was directed to read by titles only. D. HEARINGS: 1. Mayor Pro Tem Hart opened the public hearing ing Ordinance No. 1885, being, AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 50 FROM THE R -A DISTRICT TO THE R -1 -B DISTRICT, PLANNING COMMISSION AMENDMENT NO. 563, a request initiated by the City of Newport Beach, to amend a portion of Districting Map No. 50 from the R -A District to the R -1 -B District. Property being a portion of Block 93 of Irvine's Subdivision, located southerly of San Joaquin Hills Road between MacArthur Boulevard and San Miguel Drive. A report from the Planning Department., was pre- sented. The City Manager summarized the purpose of the ordinance as set forth in the staff report, noting this was a "housekeeping" zone 'change. Hearing no one desiring to address the Council, th, public hearing was closed. Adopted Ordinance No. 1885 amending a portion of Districting Map No. 50 from the R -A District to th R -1 -B District. 2. Mayor Pro Tem Hart opened the public hearing and City Council review of an APPEAL BY TALLAS MARGRAV. AGENT FOR OWNERS, from the decision of the Plannin; Commission on August 6, 1981, denying USE PERMIT NO. 2003, a request to establish a restaurant facility with on -sale alcoholic beverages and live entertainment in a portion of the Pacifica Marina Building on Mariner's Mile, and the acceptance of an Off -site Parking Agreement for a portion of the required parking spaces. Valet.parking is also proposed in conjunction with the proposed develop- meet. Project located at 2751 West Coast Highway, on the southerly side of West Coast Highway at the southerly terminus of Riverside Avenue; zoned SP -5 A report from the Planning Department, was pre- seuted. A letter from Mr, and Mrs. Louis P. Spencer, opposing Use Permit No. 2003, citing inadequate • parking in this area, was presented. The City Clerk reported that, after the printing of the agenda, a letter was received from Aubrey Bogle, Attorney representing Margaret Oser, 2505 Cliff Drive, urging Council to uphold the decision of the Planning Commission and deny the appeal. Talks Hargrave, Agent for William Clark, 14131 Yorba Street, Tustin, addressed the Council, and stated that the Use Permit was denied because of proposed off -site valet parking, which he noted had previously been approved for other similar projects in the area. Mr. Margrave stated that he had discussed the parking situation with the Police Department, and they did not seem concerned about a traffic prob- lem. The restaurant would be approximately 1800 sq. ft. and open from 5 p.m. to 2 a.m. They intend to have only a two instrument combo, so there would not be a noise problem. During course of discussion, it was noted in the staff report that the plot plan indicated that thirty -two parking spaces are located on the subject property. However, staff recommended that four of said parking spaces he deleted so as to • provide better vehicular circulation on the property. Only four of the remaining twenty -eight on -site parking spaces would be available for the restaurant's use, inasmuch as a private agreement is in effect between the Applicant and the adjoin - ing property owner that commits twenty -four spaces during the evening hours for a proposed restaurant/ office complex on the adjacent property to the west.. The Applicant is, therefore, requesting approval of an off -site parking agreement for a portion of the required parking for nighttime restaurant use. It was further pointed out that the off -site park- ing was located approximately five hundred feet from the subject property, and that patrons visit - ing the proposed restaurant would have to drop their vehicles off at the subject property, and a valet parking attendant would then park the vehicles at the off -site location and return for another vehicle. The extreme distance between the subject property and the off -site location could cause problems as vehicles accumulated on the subject property, while the valet attendants were transporting vehicles back and forth. Ocean Front, addressed the Council and indicated that it was his under- standing Mr. Clark's proposed restaurant would not affect his off -site parking agreement one way or the other. He does intend to exercise his option in the future, pending approval by the City of his plan, and has notified Mr. Clark of his proposal. Hearing no others wishing to address the Council, the public Hearing was closed. , Sustained decision of Planning Commission denying Use Permit No. 2003, with the findings as adopted by the Planning Commission designated as Exhibit nA n 3. Mayor Pro Tem Hart opened the public hearing regarding APPEAL OF ROBERT D. AND MARY R. LONGACRE from the decision of the Parks, Beaches, and Recreation Commission, denying the removal of one of three eucalyptus trees abutting their property at 701 Carnation Avenue, Corona del Mar. A report from the Parks, Beaches and Recreation Director, was presented. Ron Whitley, Director of Parks, Beaches and Recrea- tion, in response to Council inquiry, advised that the subject tree is approximately 50 feet in height, and the estimated cost to remove it would be between $250 and $300. Robert Longacre, Appellant, 701 Carnation Avenue, addressed the Council, and stated there are three large eucalyptus trees abutting his property. The tree he is requesting to be removed is one of the largest. The curb has been pushed into the street, and as a result, the tree now occupies the space where the curb alignment should be. He has been witness to several cars and trucks whose side mir- rors have been damaged because of the tree. The curb has been painted red where the subject tree is planted, which indicates to him a liability on the part of the City in recognizing the hazardous con- dition. The street is never clean due to the over- kill of the trees. In addition, he has lost a legal parking space because of the tree. In response to Council inquiry, Mr. Longacre stated that he would share in the cost of removing the tree, if he could receive the firewood. Mayor Pro Tem Hart opened the public hearing to consider a SEPARATE CUSTOM INSTALLATION RATE FOR LINDA ISLE FOR CABLE ANTENNA TELEVISION SERVICE. A report from the City Manager, was presented. Hearing no one wishing to address the Council, the public hearing was closed. Adopted Resolution No. 11040 approving an increase in the custom installation rate schedule for Linda Isle for Community Antenna Television service. E. PUBLIC COMMENTS: 1. Mrs. Glenn Dodge, 206 -30th Street, addressed the Council regarding truck traffic in residential areas, but particularly an 30th Street. Mrs. Dodge advised that she had expressed her con- cerns before the Traffic Affairs Committee and received back a letter dated August 31, which stated, in part, as follows: "The possibility of posting the street in an attempt to keep all trucks other than those serving the Market Basket was discussed with the Traffic Referee of the Harbor Municipal Court. The Referee indicated it would be very difficult to enforce such a posting, in that it discriminates by allowing some trucks to use the street and prohibiting others. "Based upon the response from the Court, the Committee voted to not recommend such a restriction to the City Council." Mrs. Dodge stated that she feels there is a solu- tion to the problem, and was her reason in coming before the City Council. Following comments by the City Manager, it was suggested Mrs. Dodge go back to the Traffic Af Committee to discuss other alternatives. F. Adopted Resolution No. 11049 amending Section IV, Personnel All Ayes Paragraph 602.10 of Resolution No. 8875 (Personnel (66) R -11049 Policies) to establish the rate of $0.21 per mile (rather than $0.22) for use of personal automobiles on City business.' 2. Proposed resolution reaffirming the City of Newport Sphere of. Beach's currently approved Sphere of Influence for Influence the Irvine Coast Area, was presented with a report (21) from the City Manager. l Motion x Motion was made to request the Mayor to appoint an ad -hoc committee to examine and analyze the support- ing documents of the staff relative to the Sphere of Influence in the Down Coast Area, prior to taking action on the proposed resolution. Motion x Substitute motion was made to adopt Resolution No. R -11047 All Ayes 11047, reaffirming the City of Newport Beach's currently approved Sphere of Influence for the Irvine Coast Area, and that the Mayor appoint an ad -hoc committee to evaluate environmental concerns in the Down Coast Area. Said ad -hoc committee shall consist of two Council Members (appointed by the Mayor), and the Mayor. The Committee shall sunset December 31, 1981, and shall submit a report to the City Council by December 14, 1981. Council Member Hummel volunteered to serve on the • ad -hoc committee. 3. A letter from Dr. John T. Chiu regarding building Building permit No. 80 -6108 granted to James Deane, was (26) presented. Council Member Hummel referred to Item No. 7 of the letter which stated that the permit was issued without due process, and asked the City Manager to comment. The City Manager read a memorandum from the Direc- tor of Building relative to the subject permit as follows: "The 69,720 sq. ft. commercial building referenced by Dr. Chiu is a 1980 project. It did receive approval of the Planning Commis- sion and City Council. Due to ownership and design changes in resubmission of the plan, the Planning Department issued approval in concept on July 27, 1981 and referred the plans back for Coastal Commission review. The Coastal Commission decided to hold a new public hearing on this development and re- noticed Dr. Chiu and other adjacent prop-, . arty owners. As of September 2, no one has made application for a building permit, or submitted plans for plan checking in the • Building Department. Therefore, a building permit is obviously not approved or issued." Following discussion with respect to the claim of Newport Harbor Area Chamber of Commerce for prop- erty damage on August 29, 1981 due to alleged stopped up City sewer main resulting in flooding the first floor of the Chamber Building, motion was made to deny said claim and refer it to the claims adjuster. In addition, staff is to provide Council with progress reports on the status of the claim, and report back to Council prior to final disposition. Don Porter, Executive Director of the Newport Harbor Area Chamber of Commerce, stated he would gladly provide a report to the Council from the time of the incident to date, if requested. The motion was voted on, and carried. 5. The following items were referred back to the for additional study, as requested: Proposed resolution approving an Agreement between the City of Newport Beach and the State Water Resources Control Board for implementation of the Newport Bay Siltation Program; Proposed resolution authorizing the Mayor and City Clerk to execute an Agreement with The Irvine Company for placement of excavated material on "Site A" in relation to Upper Newport Bay Excavation, and rescinding Resolution No. 11005; and Npt Harbor Ch /Commerce Claim (36) C -2276 (38) C-2277 (38) BA -031, $2,000,000 Increase in Budget Appro- Budget /Amn priations, and increase of $2,916,666 in (25) Revenue Estimates for the Upper Newport Bay Early Action Plan; General Fund.
