TITLE: CalRecycle Rubberized Pavement (TRP) Grant Authorization
ABSTRACT:
In order for the City of Newport Beach to receive future expenditures from the
CalRecycle Rubberized Pavement (TRP) Grant, we must identify an Authorized Agent
of the City to execute all grant related documents.
RECOMMENDATION:
Adopt Resolution No. 2012- 107authorizing the Public Works Director to act as the
"Authorized Agent" to execute for and on behalf of the City any grant documents,
including but not limited to, applications, agreements, amendments and request for
payment, necessary to secure grant funds and implement the approved CalRecycle
grant project.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Public Resources Code sections 40000 et seq. authorizes the Department of Resources
Recycling and Recovery (CalRecycle), to administer various Grant Programs in
furtherance of the State of California's efforts to reduce, recycle, and reuse solid waste
generated in the State thereby preserving landfill capacity and protecting public health
and safety and the environment.
CalRecycle offers the Rubberized Pavement Grant Program (formerly called the
Rubberized Asphalt Concrete [RAC] Grant Program) pursuant to Sections 42872 and

42873 of the Public resources Code. The purpose of the grant is to promote markets
for rubberized pavement products derived from one - hundred percent recycled
California - generated waste tires. The program is designed to encourage first -time or
limited users of rubberized pavement in two project types — RAC and Chip Seal.
The Public Works Department is in the process of applying for grant funding under the
Rubberized Pavement Grant Program and requires authorization to sign and execute
the various grant application and award documents.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2012 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING SUBMITTAL OF
APPLICATION(S) FOR ALL CALRECYCLE GRANTS FOR
WHICH CITY OF NEWPORT BEACH IS ELIGIBLE
WHEREAS, Public Resources Code sections 40000 et seq. authorizes
the Department of Resources Recycling and Recovery (CalRecycle), to administer
various Grant Programs (grants) in furtherance of the state of California's (State)
efforts to reduce, recycle and reuse solid waste generated in the State thereby
preserving landfill capacity and protecting public health and safety and the
environment; and
WHEREAS, in furtherance of this authority CalRecycle is required to
establish procedures governing the application, awarding, and management of the
grants; and
WHEREAS, CalRecycle grant application procedures require, among
other things, an Applicant's governing body to declare by Resolution certain
authorizations related to the administration of CalRecycle grants.
NOW, THEREFORE, the City Council of the City of Newport Beach
resolves as follows:
Section 1: The City Council of the City of Newport Beach authorizes
the submittal of application(s) to CalRecycle for all grants for which City of Newport
Beach is eligible;
Section 2: The Public Works Director, or his /her designee, is hereby
authorized and empowered to execute in the name of the City of Newport Beach all
grant documents, including but not limited to, applications, agreements, amendments
and requests for payment, necessary to secure grant funds and implement the
approved grant project;
Section 3: The authorizations established by this resolution are
effective for 5 fiscal years, Fiscal Years 2012/13 through 2016/17.
Section 4: The City Council finds this action is not subject to the
California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in
the environment) and '15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment,
directly or indirectly.

Section 5: This resolution shall take effect immediately upon its
adoption by the City Council, and the City Clerk shall certify the vote adopting this
resolution.
