The reading of the Minutes of the Meeting of A Ayes October 25, 1982, was waived, approved as written, and ordered filed. Motion x C. The reading of all ordinances and resolutions under All Ayes consideration was waived, and the City Clerk was directed to read by titles only. D. HEARINGS: None. E. PUBLIC COMMENTS: 1. Roger Morin, 5405 Seashore Drive, expressed appre- ciation to the Council for their sincere interest in the City, and the many hours of devoted service. F. CONSENT CALENDAR: Motion x The following actions were taken as indicated, except All Ayes for those items removed: 1. ORDINANCES FOR INTRODUCTION: None. 2. RESOLUTIONS.FOR ADOPTION: (a) Resolution No. 132 -144 of the City of Newport CATV /Group W Beach's intention to hold a public hearing Cable, Inc. on November 22, 1982,.to consider a rate Res 82 -144 increase request by Group W Cable, Inc., . (42) (formerly Teleprompter) for basic subscriber . services regarding cable television services. (Report from the City Manager) (b) Resolution No. 82 -145 extending the terms of Ad -Hoc Cmtes various committees to 1983 including Local 208 Res 82 -145 Planning Advisory Committee; the Aviation (24) Committee; the Santa Ana Heights Ad Hoc Com- mittee; and the Joint City Council /Planning Commission Ad Hoc Housing Task Force Committee. CLAIMS FOR DAMAGES - For denial and confirmation of (36) the City Clerk's referral to the claims adjuster: • (a) Judith Firestone alleging property damage as a Firestone result of collision with City vehicle on September 28, 1982. (b) Robert P. Johnson, Jr., alleging personal Johnson, Jr. injuries as a result of traffic accident on Jamboree Road at its intersection with SR -73, on August 13, 1982. (c) Thelma MacKenzie alleging property damage to MacKenzie vehicle as a result of rock falling from embank- ment onto hood of car on October 27, 1982 at 2400 Pacific Coast Highway (parking lot). 7. SUMMONS AND COMPLAINTS - For denial and confirmation of the City Clerk's referral to the claims adjuster: (a) Robert Verne Walker for personal injuries. Walker Original claim was denied by City Council on July 12, 1982. 8. REQUEST TO FILL PERSONNEL VACANCIES - For approval: (66) (Report from the City Manager) (a) One Equipment Mechanic Foreman, Equipment Maintenance Division. ACCEPTANCE OF IMPROVEMENTS IN TRACT NO. 11605 - Lot Tr 11605 27 of Tract No. 11043, located at the southerly cor- ner of Bison Avenue and MacArthur Boulevard, in the Aeronutronic Ford Planned Community; accept the pub- lic improvements; authorize the City Clerk to release the Monumentation Bond; the Faithful Perfor- mance Bond (No. 103849); and the Labor and Material Bond(No. 103849 -A) in six months provided no claims filed. ACCEPTANCE OF IMPROVEMENTS CONSTRUCTED IN CONJUNCTION Tr 9676 WITH TRACT NO. 9676 - A portion of Blocks 55 and 94, Irvine's Subdivision, located at 1100 Jamboree Road, on the easterly side of Jamboree Road across from the Newporter Inn; accept the Back Bay Drive improve- ments constructed in conjunction with Tract No. 9676. ENVIRONMENTAL QUALITY CITIZENS ADVISORY COMMITTEE: EQ /CAC All Ayes (24) Motion was made to confirm (District 4) Mayor Heather's appointment of Diane Dixon to fill the unexpired term of Lucy de Mocskonyi, ending December 31, 1982. 2. Report from Public Works regarding CONVERSION OF Vac & Abandm� TICONDEROGA STREET TO A PRIVATE STREET, was presented. Ticonderoga (90) Jim Huff, lib Tribute Court, Newport Crest, stated he has had an ongoing "battle" with members of the Newport Crest Homeowners Association regarding the proposed vacation of Ticonderoga Street, and was very much opposed to the conversion of Ticonderoga to a private street. lie stated he has addressed the Council previously on this matter and just wished to emphasize his position. Carl Cheadle, President, Newport Crest Homeowners Association, advised that they have submitted, to the City, a petition with 615 signatures representing 306 homeowners in Newport Crest in favor of vacating Ticonderoga Street. Motion x Motion was made to approve in concept the commence - All Ayes ment of vacation proceedings for the conversion of Ticonderoga Street from a public street to a private street; and direct staff to work with the community associations and the residents to prepare the material necessary for the formal vacation proceedings. 3. Report from the City Manager regarding COUNCIL POLICY Cncl Plcy L -10 STREET -END IMPROVEMENTS, was presented. (69) Motion x Motion was made to approve Council Policy L -10, as All Ayes modified to delete paragraph B -2(g). 4. Proposed ordinance, being, Park Lido U/P 2021 AN ORDINANCE OF THE CITY OF NEWPORT BEACH (88) APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND PARK LIDO, LTD., DEVELOPMENT AGREEMENT NO. 1, an agreement between the City of Newport Beach and Park Lido, Ltd., was pre- sented with a report from Planning. The City of Newport Beach has requested, and Park Lido, Ltd. has agreed to advance fifty percent of the cost of the installation of a traffic signal at the intersection of Hospital Road and Placentia Avenue in considera- tion of the City providing Park Lido, Ltd. with continuance of their right to develop the property in accordance with the approved Traffic Study; and the acceptance of an Environmental Document. A modification in the City's Parking Standards is also requested to permit compact car parking on the site to be further approved by the City Traffic Engineer. Report from the City Attorney, was presented. The City Manager recommended the subject ordinance be continued until the ordinance establishing the procedures and requirements for the consideration of development agreements had its public hearing, which is scheduled for November 22. Motion x Motion was made to continue the subject ordinance All Ayes to January 10, 1983. J. CURRENT BUSINESS: 1. APPEAL OF LEVI RODRIGUEZ FROM DENIAL OF APPLICATION PW /Rodriguez TO CONSTRUCT A CURB CUT AT 506 "I" STREET. Appeal (80) Report from the Public Works Department, was pre- sented. The driveway is to serve a proposed carport, and provide additional uncovered off - street parking. Presently the curb in front of 506 "I" Street is painted red for the entire block. The proposed curb cut is opposite an alley approach. If the proposed curb cut were to be allowed, no off - street parking would be lost. x Motion was made to grant the application. K.
