ROLL CALL. nt x x The Mayor announced that the City O/C-John Council would immediately adjourn to Wayne Airpori closed session which is authorized by Government Code Section 54956.9(c), in that the City Council is presently deciding whether to initiate litigation against the Orange County Board of Supervisors regarding the certification and approval, by the Orange County Board of Supervisors, on February 26, 1985, of EIR 508, the Airport Master Plan, and the Airport Access Plan. This closed session is necessary to allow legal counsel to fully inform the City Council as to the facts and circumstances which may warrant litigation, the legal authority upon which the ligitation would be based, and other matters pertaining to the potential lawsuit. The position of the City of Newport Beach in the possible litigation would be prejudiced if the legal or factual basis for the possible litigation is discussed in open session. Council Member Cox entered the meeting at 4:20 p.m. • The Council reconvened in regular session at 6:25 p.m. The Mayor made the following statement at this time: 1 °The City Council met in executive session today with its City Attorney and Special Airport counsel to discuss various matters involving John Wayne Airport. The City Council has under ongoing review a range of options concerning the City's response to the proposed massive expansion of the airport. These alternatives include litigation and further discussions with the County about limiting the number of flights, reducing the size of the new airport terminal facilities, and locating a suitable site for an additional commercial airport by Orange County.
