Meeting of .June 8, 1987, was waived,
approved as written, and ordered filed.

D. HEARINGS:
Mayor Cox opened the public hearings
pertaining to the formation of:
1. ASSESSMENT DISTRICT 87 -1 (CANNERY
VILLAGE IMPROVEMENTS);
AND
2. ASSESSMENT DISTRICT 87 -2 (NEWPORT /BALBOA
REALIGNMENT);

SQUARE IMPROVEMENTS).
Report from the Planning Department, was
presented.
The City Manager gave an overview of the
three proposed assessment districts,
advising that the staff has held a
number of informal hearings regarding
formation of the districts, and as a
result, are recommending that Assessment
District 87 -1, (Cannery Village
Improvements) and 87 -3 (McFadden Square
Improvements) be continued to August 24,
1987, for the reasons as set forth in
the staff report.
With regard to Assessment District 87 -2
(Newport /Balboa Realignment), the City
Manager advised that inasmuch as a
majority protest has been received, it
is recommended the hearing for this
assessment district be closed and that
all proceedings pertaining to the
formation of this particular assessment
district be: abandoned.
The City Manager stated that with
respect to the Cannery Village
Improvements, those who attended the
informal hearings, opposition was

expressed to the plan, as presented, due IAsmt Dist
to the cost of the assessments, extent 87 -1/2/3
of improvements, etc., and therefore,
staff feels the scope of the project
should be sealed down as outlined in the
staff report:.
Pertaining to the McFadden Square
Improvements, it was recommended by the
staff that they be directed to eliminate
certain residential properties from the
assessment district, and that they
prepare a plan for the repair of damaged
or deteriorated curbs, gutters, and
sidewalks in the commercial areas only,
and to also prepare a plan for some type
of special treatment for the McFadden
Square Plaza.
The following persons addressed the
Council regarding the proposed
assessment districts:
Michael. Hynes, 3345 Newport
Boulevard, submitted 21 individual
letters of protest from property
owners in opposition to the Cannery
Village: streetscape and McFadden
Square Improvements.
John Shea, 2214 W. Ocean Front,
objected to the proposed assessment
costs.
Erling C. Arend, 604 Park Lane,
Corona, Attorney representing Margo
Payne, owner of property on Court
Street, stated that his client
concur:; with the recommendations of
staff with regard to Assessment
District 87 -2 and 87 -3.
Joan Jacobs, 825 W. Bay Avenue,
stated she felt everyone who
benefits from the proposed
improvements should share in the
cost.
Frank Trans, 2018 E. Bay Front,
representing St. James Episcopal
Church„ advised that the owners of
Parcel Nos. 047 - 031 -22 and 23,
within proposed Assessment District
87 -1, unanimously protest the
formation of the assessment
district and request that said
properties be deleted from the
district.

Leopold Avallone, 1412 W. Ocean
Front, and owner of property in
Cannery Village, spoke in support
of proposed Assessment District No.
87 -1, and stated he felt everyone
will benefit from the improvements.
He felt that Cannery Village, in
its present state is an "eyesore."
Walter Racket, owner of 100 -108
McFadden Place, spoke against the
proposed removal of 16 parking
spaces at McFadden Square, and
requested the plan be reconsidered
as parking is greatly needed in
this area.
William Rude (no address given)
spoke In support of deleting
certain residential properties from
Assessment District 87 -3.
Jack Williamson, owner of property
on 31st: Street, objected to the
proposed paving of alleys in
Assessment District No. 87 -1,
inasmuch as he has already paid for
this improvement behind his
property some time ago. He also
suggested the City designate an
official tree for the area and make
provisions for the planting of said
tree when the property owner is
ready to beautify their immediate
area.
Paul Michalczyk, 2414 Newport
Boulevard, owner of Balboa Boat
Yard, stated he does not consider
his property to be in the McFadden
Square area, and objected to the
proposed assessment. He also
suggested the Council consider
establishing a Redevelopment Agency
to fund the proposed improvements.
Lou DeVita, 2000 W. Ocean Front,
stated that he has received two
assessments, of which he opposes,
inasmuch as he is about to retire
and his home is almost paid for.
Tony Herman, owner of Boozy Rouge
Restaurant, stated he felt that
many of the proposed improvements
for Cannery Village are beneficial;
however, he does oppose the street
plan to make 31st Street one -way
going West. He stated he felt it
would impair their ability to

operate and would cause problems.
He stated he was also speaking on
behalf of the owner of the St.
Tropez Restaurant.
Walter Kaiser, 85 Vista Del Golfo,
Long Beach, spoke against proposed
Assessment District 87 -2 and 87 -3,
stating he felt it was an "unfair"
situation and that everyone should
be taxed, rather than just the
property owners in each district.
Arsene "Blackie" Gadarian, P.O. Box
10339, Lahaina, Maui, spoke in
opposition to Assessment Districts
87 -2 and 87 -3, and requested that
his property at the corner of 26th
Street and Newport Boulevard (lots
14 and 15) be deleted from the
proposed district.
Sid Soffer, 900 Arbor, Costa Mesa,
owner of 107 21st Street, stated he
was opposed to the assessment
district for McFadden Square under
the current plan. He also does not
feel palm trees are the best type
of tree for the subject area. He
stated that the Ocean Front area
definitely needs a "face lift," and
that perhaps funding the
improvements by way of a
redevelopment agency should be
investigated. He also felt that
the monies collected from the
parking meters should be put back
into this area to provide
additional parking as has been
discussed in the past.
Roy Jackson, owner of four lots on
31st Street in Cannery Village,
spoke in support of the assessment
district. He also commented that
he was "appalled" at the way the
public: is being allowed to ridicule
the staff during these proceedings.
Bob Rubian, owner of Crab Cooker
Restaurant on 22nd Street, stated
that lie would favor an assessment
district for a parking structure,
but not for the improvements
proposed. He stated that the
majority of the complaints he hears
in this area is regarding the lack
of parking.

Dr. Gerald Paul, 107 24th Street,
submitted a copy of a petition
containing over 30 signatures in
opposition to Assessment District
• 87 -2.
Iry Gellman, owner of 20th and
Balboa Boulevard, suggested that
consideration be given to improving
"what we have rather than starting
new".
Sara Gadarian, lessee of property
at the corner of 26th Street and
Newport Boulevard, spoke in
opposition to continuing the public
hearing, and urged the Council to
take final action at this time.
Tony Shepardson, 421 31st Street,
spoke :in support of improving the
Cannery Village area and thanked
the Council and staff for the time
and efforts that have been given to
this project.
Vin Jorgensen, 1533 Antigua Way,
stated that he did not own any
property within the proposed
• assessment districts, but is
concerned about the assessment
figures and doesn't understand the
disparity as to some of the
amounts.
Frances Bury, owner of property on
the island strip, stated that the
island strip property owners have
never been considered a part of
Cannery Village until the proposed
assessment District. She stated
that she was also concerned about
the proposed re- striping and the
problems she felt it could cause.
She also urged the Council to take
action at this time, and not
continue the public hearing.
Jerry king, Land Use Planning
Consultant, representing property
owners within the assessment
districts who are unable to attend
this hearing, stated that his
clients are basically supportive of
the proposed improvements, but
• because of the assessments costs,
feel the project should be scaled
down to a more affordable level.

At this time, the staff responded to
the following questions raised by the
speakers:
Why the dramatic change in cost
from the original figure?
When the plan was originally
brought forward, it involved
nothing; more than a landscaping
program and some brick paving
treatments at the various
intersections, and when they
embarked on the program now under
consideration, the property owners
they had met with over the course
of several months, indicated that
they would like to see more in the
way of improvements extended down
22nd and 23rd Streets in the area
of landscaping and new curbs and
gutters, etc. The cost estimates
in the preliminary engineer's
report involved the removal and
replacement of all of the curbs,
gutters and sidewalks, and they
recognized that this may not be
necessary, but it was a starting
point f-or discussions. The second
major factor that must be
considered is that when they began
this program using assessment
districts, they had never taken a
close look at what it would cost to
form the districts through the
bonding process and those costs are
much higher than anticipated.
How are the assessments voted on or
tabulated?
The votes are based upon land area
owned within the total boundaries
of the assessment district. At the
time of the public hearing, the
protests are tabulated and if there
is over a 50% protest by area, then
the Council's right to proceed is
terminated.
How is the assessment cost
determined?
The assessments were spread on the
basis of the frontage of the
properly and benefit. The cost
cannot be spread on the basis of
assessed valuation, or it would
violate Proposition No. 13.

How were the boundaries determined
for each of the Assessment
Districts?
The original boundaries for the
•
Cannery Village /McFadden Square
Specific Area Plan were determined
in 1973 on adoption of the City's
General Plan, and the reason the
residential areas were incorporated
into that plan is unknown at this
time; however, they are somewhat
subject to the intrusion of the
commercial areas and the tourists,
and in addressing the problems in
the area, they felt the solution
should also include those
neighborhoods. With regard to the
island properties, they have been
in the boundaries of the Specific
Area Plan since its inception. The
boat yard properties at 26th Street
and Newport Boulevard have been in
the district for the entire period.
The reason that the two areas have
been held together as a single unit
in the Specific Area Plan process
is because they do share common
problems, primarily traffic and
circulation.

Why wexen't Redevelopment dollars
considered for the funding of the
assessment districts?
The staff explored the feasibility
of establishing a Redevelopment
Agency with the idea of capturing
the tar: increment financing for the
entire areas within the boundaries,
but there was no support from the
Planning Commission or City Council
when the program was brought
forward.
When will further meetings be held
on this; subject and will the
rp opert:y owners be notified?
If the Council takes the
recommended action, as set forth on
the agenda, then Assessment
District 87 -1 and 87 -3 will be
continued to a time certain with
specific instructions to staff.
Notices will be sent out again to
•
all property owners within the two
districts indicating what their
proposed assessment would be, and

notifying them of the revised plan. Asmt Dist
Informal hearings will be held with 87 -1/2/3
impacted property owners on the new
plan prior to this item coming back
to the Council.
The City Manager pointed out that
as of this date, Assessment
District No. 87 -2 (Realignment of
Newport /Balboa Boulevard) had
received a 51.5% protest.
Assessment District No. 87 -1
(Cannery Village) prior to this
public hearing had a 24.4% protest,
with Assessment District No. 87 -3
(McFadden Square) receiving a 42.3%
protest.
Council Member Sansone discussed
the possibility, and indicated his
support of using tax monies from
the three subject areas to fund the
proposed improvements under
consideration. He also felt that
if public improvements were
installed in these areas, such as
new curbs, gutters, and sidewalks,
then it could give the business
owners an incentive to improve
their particular piece of property.
Following discussion, motion was made to
continue the public hearing on
Assessment District 87 -1, to the City
Council Meeting of August 24, 1987, and
direct staff and the consultant to
revise the project as follows:
Prepare plans and cost estimates
that involve only the repair of
damaged or deteriorated curbs,
gutters, and sidewalks; the
installation of these improvements
where they currently do not exist;
and the installation of concrete
alleys within the Cannery Village
area; and further, that staff also
investigate alternative means of
financing the proposed
improvements, and bring back to the
Council at the time of the
continued hearing.
Council Member Plummer requested that
when this item is brought back to the
Council, the staff identify in their
report the City's contribution, as well
as the property owner's contribution,
and that this be made a part of the
foregoing motion, to which there were no
objections.

The motion, as amended, was voted on and
carried.
Motion was made to close the public
hearing with regard to Assessment
District No. 87 -2, and adopt Resolution
No. 87 -77, ,abandoning all proceedings
pertaining to the formation of
Assessment District 87 -2, but that
reconsideration of this entire project
be given at some future date.
Carl W. Ackerman, 110 22nd Street,
addressed the Council and referred to
his letter of protest dated June 20,
1987, opposing the project in its
present form. He stated he was totally
supportive of many features of the plan
and is willing to contribute financially
to the upgrading of McFadden Square. He
stated that he would withdraw his
opposition to the plan if revised, as he
is very enthusiastic about improving the
area. He also does not oppose a
financial obligation on his part to fund
the improvements. He stated that if the
percentages of protest for McFadden
Square total over 50%, then he would
withdraw his opposition.
Mr. Helms, co -owner of the boat yard at
26th Street and Newport Boulevard,
addressed the Council and stated that if
and when the restriping of the
Newport /Balboa Boulevard is
reconsidered, he would suggest the
safety factors be looked into prior to
approval of such a change. He also
stated that he was opposed to Assessment
District 87 - -3, as based on the
information he has received, it does not
fulfill the instructions given to staff
in his opinion as to what will be the
next step. He also complimented Chris
Gustin of the Planning Department for
the excellent work he has done on this
project. He further requested that the
hearing be continued to September 28,
rather than August 24 so that he may be
in attendance.
Meta Morrison, 2212 and 2212'k Ocean
Front, addressed the Council and stated
that she is being assessed approximately
$16,000 for improvements which she does
not feel will be that beneficial to the
area. She also suggested that parking
meter fees be increased which could
result in tourists spending less time on
the beach.

Pete Barrett, owner of property on
Lafayette, addressed the Council and
stated that his wife has property on
Villa Way, and that both are concerned
over their proposed assessments. He
discussed assessed value as opposed to
market value with regard to Proposition
No. 13. He also pointed out that both
properties have been improved with
curbs, gutters, sidewalks and concrete
alleys, which he would not like to see
removed.
Following discussion, motion was made to
continue the public hearing on
Assessment District 87 -3 to September
28, 1987, and direct staff and the
consultant to delete those residentially
zoned properties between 19th Street and
20th Street; those residentially zoned
properties on the bayside of Newport
Boulevard between 20th and 21st Streets;
those residentially zoned properties to
the west of the centerline of the alley
separating 23rd Street and 24th Street;
and the four residential lots east of
24th Street on West Oceanfront from the
boundaries of the Assessment District;
and prepare plans and cost estimates
that involve only the repair of damaged
or deteriorated curbs, gutters, and
sidewalks in the commercial areas only;
and increase the City's participation in
the Assessment District to include the
improvement of the proposed plaza at the
base of the Newport Pier and the Ocean
Front Parking Lot.
Motion was made to change the date of
the continued hearing on Assessment
District 87 -1 (Cannery Village) to
September 28„ 1987, rather than August
24, 1987.

recommending approval of HARBOR PERMIT
APPLICATION #129 -2801 (subject to the
conditions oil approval listed in the
staff report) of James Carter to revise
the commercial docks bayward of 2751 and
2827 West Coast Highway, was presented.
The City Clerk advised that a letter was
received this date from the property
manager of Earl's Landing Building,
requesting this item be removed from the
agenda, inasmuch as a revised plan will
be drawn. In addition, a letter was
received from Richard T. Mudge, Attorney
representing Avalon Pacific, Inc.,
opposing the referenced application.
Motion was made to refer the subject
harbor permit application back to the
staff.
2. Report from the Fire Chief recommending
that staff review and amend Chapter 5.14
of the Newport Beach Municipal Code and
that the proposal submitted by SCHAEFER
AMBULANCE SERVICE, INC., be held until
the Fire Department's review of the
Ambulance Regulations is complete in 90
days, was presented.
Marc Winburn„ 1612 Cornwall Lane,
representing Schaefer Ambulance Service,
Inc., and author of the subject
proposal, addressed the Council and
outlined their request. He stated that
their proposal does not require any
increased responsibility, liability, or
costs on the part of the City. He
summarized the advantages of their
proposal as enumerated in Section 4 of
the subject document. He stated that
their request will still be valid in 90
days when the Fire Chief is to complete
his investigation.
Larry Seals, Seals Ambulance, addressed
the Council and stated that they have
been operating in the City since 1949,
and pride themselves on the service they
give to Newport Beach. He stated that
their company has been a "first
responder" for the past eight years. He

1. APPOINTMENTS TO BOARDS AND COMMISSIONS:
BOARD OF LIBRARY TRUSTEES

Council Member Sansone stated that with
all due respect to the Appointments
Committee, he would like to add the name
of Gordon Glass as a nominee to be
considered with Phyliss Drayton and John
Nicoll. He stated that Mr. Glass is
currently a member of the Library Board,
and has worked very hard evaluating the
Automation proposals, contributing
invaluable experience to the Board.
Council Member Strauss nominated Karen
Evarts, current Chairman of the Library
Board, to be considered with nominees C.
Bennett Jackson and Carl Writer. He
stated that she has been an outstanding
member of the Board and that her
contributions should be recognized.
In view of the foregoing, Gordon Glass
was assigned the red light.
Phyliss Drayton was assigned the white
light.
John Nicoll was assigned the green
light.
The City Clerk advised that John Nicoll
was appointed to a four -year term ending
June 30, 1991.
Karen Evarts was assigned the red light.
C. Bennett Jackson was assigned the
white light.
Carl Writer was assigned the green
light.
In view of the foregoing tie, Karen
Evarts was assigned the red light; and
C. Bennett Jackson was assigned the
green light.
Karen Evarts was reappointed to serve a
four -year team ending June 30, 1991.
