DATE; July 23, 1990 Mayor Plummer and Marilee Stockman of the Arts Commission presented CULTURAL GRANTS to the various organizations approved by the City Council on June 11, 1990. A. ROLL CALL. B. Reading of Minutes of Meeting of July 9, 1990, was waived, approved as written, and ordered filed. C. Reading in full of all ordinances and resolutions under consideration was waived, and City Clerk was directed to read by titles only. HEARINGS: �1. Mayor Plummer opened the public hearing to Fire confirm the report of the Fire Chief Abat concerning the COST OF ABATEMENT OF WEEDS (41) AND OTHER NUISANCES. Hearing no one wishing to address the Council, the public hearing was closed. Motion was made to adopt Resolution No. 90 -74 confirming the report of the Fire Chief concerning the cost of the abatement of weeds and other nuisances, and requesting the Auditor - Controller of Orange County to enter the amount of each assessment referred to in said report on the County Tax Roll. 2. Mayor Plummer opened the public hearing and City Council review of an APPEAL BY DANA L. CARL from the action taken by the Planning Commission on June 7, 1990, to deny USE PERMIT NO. 3382, ON PROPERTY LOCATED AT 361 HOSPITAL ROAD. A request to permit the establishment of a permanent automobile washing and detailing facility for the staff and physicians of Hoag Memorial Hospital and Newport Lido Medical Center. Said facility will be located within the surface parking area in the northeasterly corner of the Newport Lido Medical Center property, located in the A -P District. Report from the Planning Department. Appeal application of Dana Carl. The City Clerk advised that after the agenda was printed, a letter was received from Elaine Cerf withdrawing her previous objection to the subject proposal. Volume 44 - Page 249 90 -74 /P 3382 CITY OF NEWPORT BEACH COUNCIL MEMBERS F �A \4p' ROLL CALL July 23, 1990 MINUTES OI 1 - The City Manager noted that a majority of U/P 3382 the Planning Commissioners were of the opinion that the proposed facility would adversely affect the residential uses • adjacent to the subject property; and that the car wash use would only benefit special persons (i.e., staff and physicians at the Newport Lido Medical Center and Hoag Hospital); and therefore, recommended denial of the subject use permit. Dana Carl, owner of Sterling Automotive Detail, addressed the Council and advised that he has met on several occasions with those residents opposing the proposed use permit, and following these discussions their objections have been withdrawn, and an agreement has been executed with the Park Lido Association, Newport Lido Medical Center and Sterling Detail regarding this matter. He stated the proposed car wash /detail operation is strictly for the tenants, physicians and staff of Hoag Hospital and Newport Lido Medical Center, and there will be no soliciting or advertising of this operation on the outside. Michael - Lombardi, owner of Newport Lido Medical Center, addressed the Council and • explained the agreement with Park Lido Association, et al. He also stated that signs will be posted at the car wash operation "for tenants and staff only," and that 24 -hour security will be provided. Reference was made to storm water entering the sewer system, wherein it was noted that if the subject use permit is approved, Conditions No. 9 and 10 would be imposed as follows: "9. That the wash rack area be raised 6 inches above the parking lot with a minimum 6 inch curb surrounding the area on all sides. The wash rack area shall also be protected so as to prevent drainage from the parking lot from entering the sewer system. The drain shall be connected to the sewer system and have a grease trap. The design and installation of the above facilities shall be approved • by the Utilities Department. That the car wash area shall U/P 3382 be covered with a permanent roof in order to ensure that the drain provided to the • sewer system is shielded from rain water. A canvas awning may be considered a permanent roof if it is well maintained and extends at least 2 feet beyond the perimeter of the proposed raised berm." The Public Works Director also pointed out that there is a requirement that the effluent from washing be discharged into the sanitary sewer system and not into the storm drain system, and rain fall run -off may not enter the sanitary sewer system, and in order to accomplish that, these requirements are embodied in the above Conditions No. 9 and 10. Mr. Lombardi advised that he was prepared to comply with the subject conditions in order to obtain approval of the use permit. Tom Gotier, 4211 Patrice Avenue, Park Lido Association, addressed the Council and stated they have no further objections to the proposed car wash /detail operation. • Hearing no others wishing to address the Council, the public hearing was closed. Following discussion among the Council, Condition No. 4 was modified to the effect that "no radios or sound amplification shall be permitted on the premises, and Condition No. 11 was changed to read: "That the hours of operation shall be limited between the hours of 8:00 a.m. and 6:00 p.m., Monday through Friday." Motion x There being no further comments, motion was All Ayes made to overrule the decision of the Planning Commission, and approve Use Permit No. 3382, based on the Findings and Conditions of Exhibit "A," as modified in the foregoing. E. PUBLIC COMMENTS: Steve Stafford, 220 -1/2 34th Street, addressed the Council regarding a nuisance problem at the Lucky Market /Carl's Jr. shopping center on 32nd Street. He stated • for the past four months he has had a problem sleeping as a result of the noise emanating from the shopping center; he has notified the Police Department, as well as . He suggested Carl's Jr. be requested to close earlier in order to eliminate the noise and congestion in the • area, and reported that due to the large crowds, emergency vehicles do not have access to the area should there be a fire, etc. The City Manager advised that he has met with Mr. Stafford on this matter, and as a result, the Police Department is currently in discussion with Carl's Jr., and Lucky's, as well as other merchants in the area, in an effort to resolve this problem. As to the suggestion to close Carl's Jr. earlier, the City cannot "call back" the use permit for the shopping center as it does not contain provisions giving authority to the City Council to change the hours of operation. In addition, he recommended the License Department no longer authorize Special Events Permits in Begonia Park, as it is the only active recreational use south of the highway in Old Corona del Mar. There being no further comments, motion was made to approve Application No. 90 -201, subject to conditions listed in the staff report. Report to the City Manager regarding ACTIONS TAKEN BY THE PLANNING COMMISSION ON JULY 5, 1990, AND PLANNING COMMISSION AGENDA FOR JULY 19, 1990. Motion was made to schedule public hearing /P 1758 on August 13, 1990, on Use Permit No. 1758 (Amended) - Nina's Newport Beach on property located at 3388 Via Lido; and to receive and file the remaining actions. Report from the Public Works Department McFadde recommending approval of proposed Sq Asmt resolution CALLING FOR CONSTRUCTION BIDS, Dist 59 APPROVING THE PLANS AND SPECIFICATIONS C -2780 [MCFADDEN SQUARE /ASSESSMENT DISTRICT NO. (38) 591, AND AUTHORIZE THE CITY CLERK TO ADVERTISE FOR BIDS TO BE OPENED AT 11:00 A.M., ON SEPTEMBER 5, 1990. Thomas E. Hyans, President, Central Newport Beach Community Association, addressed the Council in support of the proposed improvements, but indicated he had three concerns its follows: 1) Traffic Signal at 21st Street; 2) Open space area between the Dory Fleet and Newport Pier; and 3) Vehicular access to the beach between the Dory Fleet and Newport Pier. Mr. Hyans stated he felt the signal at 21st Street will impact the residents on the Peninsula to a great extent as the signal will only be activated when traffic is at its worse. He is further concerned that the open space area between the Dory Fisherman and the pier will be used by the Marine Department for construction of lifeguard stands, etc., and has counted as many as 22 vehicles parked on the beach between the Dory Fleet and Newport Pier. Volume 44 - Page 259 CITY OF NEWPORT BEACH COUNCIL MEMBERS'+y, `o'` July 23, 1990 u Motion All Ayes is • x MINUTES The Public Works Director stated that a public hearing will be held on the McFadden Square Assessment District No. 59 on September 24, 1990, and the purpose of the hearing will be to discuss the components of the project. With regard to the proposed traffic signal at 21st Street, he felt the controller settings can be controlled in such a way they will recognize the times when there are peak traffic periods on Balboa Boulevard and will give priority to Balboa Boulevard. The City can also monitor the signal operation from the Traffic Engineering Division at City Hall. Reference was made to the number of vehicles currently parking on the beach in the McFadden Square area, wherein the City Manager stated that once the new restroom and lifeguard station is completed, and the old restroom is demolished, only emergency and authorized vehicles would be allowed to park on the beach. Motion was; made to adopt Resolution No. 90- 84. ORDINANCES FOR ADOPTION: None. 1I. CONTINUED BUSINESS: 1. RICHARD MILLER REQUEST FOR NONSTANDARD IMPROVEMENTS - Report from Public Works dated July 9, 1990, recommending approval, subject to the execution of an agreement for nonstandard improvements to construct steps and raised planters 19 inches in height and pilasters 42 inches in height encroaching into North Bayfront 34 inches, and planters 19 inches in height and pilasters 42 inches in height encroaching into Park Avenue 24 inches, at 101 North Bayfront, Balboa Island. Council Member Watt reported the results of a survey she did on Balboa Island (excluding; Grand Canal) with respect to the number of encroachments, as follows: 1) Out of 200+ houses, 448 of the homes have fences, walls, or hedges that abut the sidewalk. 2) 398 of the above homes have added another walkway from 1- 1/2 - 4 feet in width. 3) 148 of the above homes do not have any encroachments. She stated that Monday, July 30, 1990, has been declared as Olive Crest Day in Orange County, and that Olive Crest will be honored at the National Charities Award dinner in Washington, D.C.
