DATE: September 10, 1990 A. ROLL CALL.. B. Reading of Minutes of Meeting of August 27, 1990, was waived, approved as written, and ordered filed. C. Reading of all ordinances and resolutions under consideration was waived, and City Clerk was directed to read by titles only. D. HEARINGS: 1. Mayor Pro Tem Sansone opened the public hearing and City Council review of VARIANCE NO. 1165, request of DAN HANGSLEBEN to permit the construction of a single family dwelling on property located at 3725 OCEAN BOULEVARD, a portion of Block A, on the southwesterly side of Ocean Boulevard between Poinsettia Avenue and Poppy Avenue, in Corona del Mar. The property is located in the R -1 District which exceeds the 24 foot basic height limit in the 24/28 Foot Height Limitation District. The proposal includes a request to permit the new construction to exceed the height of top of curb on Ocean Boulevard to the extent that the existing garage and fence currently extend above top of curb (varies between 4 feet 6 inches and 8 feet 6 inches). The proposal also includes a modification to the Zoning Code so as to allow the proposed structure to encroach 10 feet into the required 10 foot front yard setback. The City Clerk advised that after the agenda was printed, a letter was received from Shannon Gallagher, Attorney for Kay and Virginia Smallwood, owners of the subject property, requesting this hearing be continued to November 12, 1990. Mr. K. J. Smallwood, 3729 Ocean Boulevard, owner of the subject property, addressed the Council and stated that his reason for requesting the continuance is to review the status of this variance application, inasmuch as the applicant, Dan W. Volume 44 - Page 302 1165 89 -2(J) Jack Barry, 3712 Ocean Boulevard, addressed the Council and indicated he was in support of the recommended Findings and Conditions approved by the Planning Commission on • August 9, 1990, including the additional Finding No. 9 and revised Condition No. 2 set forth in the staff report's addendum. Mayor Pro Tem Sansone stated that concern has been expressed throughout the neighborhood that the City has been too lenient in granting encroachment permits for driveways across the Ocean Boulevard parkway, and in allowing garages to encroach up to the front property line. The effect of this practice has been the creation of deep driveway cuts across the public right -of -way to the detriment of the public use of the area. He added that in this particular case, the applicant should be looking toward keeping the curb cut in the same :Location and moving the garage as far back as possible so as to keep the grade of the driveway to a minimum. In addition, Mayor Pro Tem Sansone also noted that the City will be spending a considerable amount of money shortly on upgrading the view points at Little Corona and Inspiration Point, and that the Ocean • Boulevard parkway between these two points should be restored and protected as much as possible. He suggested that turf -block be required on driveways so as to lessen the visual impact of concrete as much as possible. Mayor Pro Tem Sansone also indicated that he did not believe the 18 inches of additional height over the entry way, as approved by the Planning Commission, was either justified or warranted. Motion x There being no further comments, motion was All Ayes made to continue the public hearing to Tuesday, November 13, 1990 (Monday, November 12, is Veterans Day Holiday). 2. Mayor Pro Tem Sansone opened the public hearing regarding GENERAL PLAN AMENDMENT NO. 89-2(J). A request to amend the General Plan Circulation Element to add a roadway classification for a "Commuter" Two Lanes Undivided, and classify Marguerite Avenue between East Coast Highway and 5th . Avenue in Corona del Mar as a "Commuter" roadway. Report from the Planning Department. Motion was made to adopt Resolution No. 90 -86, adopting General Plan Amendment No. 89 -2(J). 3. Mayor Pro Tem Sansone opened the public hearing regarding GENERAL PLAN AMENDMENT NO. 90 =2(B). A request to amend the General Plan Circulation Element to delete a segment of University Drive from the City's Master Plan of Streets and Highways consistent with recent actions by the Orange County Board of Supervisors to delete the same segment from the County Master Plan of Arterial Highways. Report from the Planning Department. There being no one wishing to address the Council, the public hearing was closed. Council Member Cox commented that in the past he has always opposed the proposal to delete University Drive from the City's Master Plan of Streets and Highways. He stated that he felt University Drive is a vital part of the transportation and circulation element in the City, inasmuch as Pacific Coast Highway and Route 73 are the only other routes to get across the Bay. As a representative of the San Joaquin Hills Transportation Corridor Agency, he has been involved in many of the discussions that have taken place to evaluate the elimination of University Drive, and as a result, he will support the recommendation. He also pointed out that this action will not alleviate the problem of traffic. He noted that the San Joaquin Hills Transportation Corridor Agency has authorized $13 Million for the improvement of Route 73 /Corona del Mar Freeway, and it is incumbent upon the other agencies, such as the City of Newport Beach, etc., to also participate in the improvement program, because it is those improvements that substitute for the deletion of University Drive. r' GPA 90 -2(B) (45) In view of the foregoing comments, motion IRes 90 -87 was made to adopt Resolution No. 90 -87, adopting General Plan Amendment No. 90- 2(B). Volume 44 - Page 303 • Motion All Ayes 0 x CITY OF NEWPORT BEACH MINUTES September 10, 7.990 E. PUBLIC COMMENTS: 1. Joseph E. Bockrath, 20451 Bayview Avenue, Santa Ana Heights, addressed the Council and submitted a petition containing 70 signatures of residents in the area, requesting the County of Orange and City of Newport Beach to extend the Santa Ana Heights Horseback Riding Trail 44 into the newly developed Newport Beach Regional Park, and in so doing, the trail would then connect to the Orange County Trail System, and benefit all Orange County residents. He stated that in the new plans for the Regional Park, the County is proposing that equestrian use not be allowed. Mayor Pro Tom Sansone advised Mr. Bockrath to make his comments known to the County as the City of Newport Beach can only take action on this matter in an advisory capacity. Council Member Turner advised that Upper Newport Bay Regional Park is an issue that will be coming back to the City Council for a formal recommendation to the County, and that Mr. Bockrath could make a presentation at that time, as well. 2. Sid Soffer, 900 Arbor Street, Costa Mesa, property owner in McFadden Square, addressed the Council and suggested the revenue generated from the parking meters at McFadden Square be used to "earthquake - proof" some of the older buildings in the Plaza area. In view of the foregoing, motion was made to schedule the subject hearing for September 24, 1990. 3. BAY AVENUE (ASSESSMENT DISTRICT NO. 60). Resolution accepting petitions and making appointments in proposed ASSESSMENT DISTRICT NO. 60. Resolution adopting map showing the boundaries of proposed ASSESSMENT DISTRICT NO. 60. Resolution declaring intention and covering preliminary determination to order the construction of certain improvements in proposed ASSESSMENT DISTRICT NO. 60; ordering the preparation of a report describing the district to be assessed to pay the costs and expenses thereof; and providing for the issuance of bonds. Resolution passing on the report of the engineer giving preliminary approval for proposed ASSESSMENT DISTRICT NO. 60; and setting a public hearing for 7:00 p.m. on October 22, 1990.
