Mayor Sansone presented a Proclamation to
Richard Grant, President, Newport Beach
Chapter of National Management Association in
recognition of June 1 through 6, 1992 as
Management Week in Newport Beach.
A Certificate of Appreciation, along with
mementos from the City, was presented to
newspaper reporter, Iris Yokoi from the Daily
Pilot for her exemplary news coverage of
Newport Beach during the past two years.
Mayor Sansone stated that Iris will be leaving
the Daily Pilot to work for the Los Angeles
Times and will be serving inland cities in
Orange County.

BEACH MUNICIPAL CODE SO AS TO
REVISE THE DEFINITION OF THE TERM
"GRADS," (PLANNING COMMISSION PCA 753
AMENDMENT NO. 753).
Report from the Planning Department.
The Planning Director summarized the
purpose of the proposed ordinance noting
that the refined language defines the
term "Grade" as "the unaltered natural
vertical location of the ground surface"
unless two exceptions apply. Such
terminology incorporates language from
the Uniform Building Code so as to
minimize any confusion between the
Building Code and the Zoning Code. The
first exception is for sites which have
approved grading plans or maps that were
approved at the time of subdivision. In
such cases, grade shall be finished
grade as shown on the plan or map so
approved. The second exception for
determining "grade" has to do with sites
located in Flood Hazard Areas within the
City. The existing Code incorrectly
makes reference to Flood Hazard
Protection Maps. Said maps are
correctly called Flood Insurance Rate
Maps and so the Code has been revised
accordingly.
Hearing no one wishing to address the
Council, the public hearing was closed.

The Planning Director noted that the
applicant proposes to demolish the
structures on the two lots, and utilize
the site for two, two -unit residential
projects. The applicant is also
proposing to amend a portion of
Districting Map No. 14 so as to
establish a six (6) foot front yard
setback on the Agate Avenue frontage of
the site. Said setback is consistent
with the six (6) foot front yard setback
required for all residential properties
in the same block of Agate Avenue.
Hearing no one wishing to address the
Council, the public hearing was closed.

Report from the Planning Department.
Council Member Hedges excused himself
from the podium due to a possible
conflict of interest.
It was noted that as a means of better
controlling the problems related with
short term lodging units, sometimes
referred to as "party houses," the City
Council introduced Ordinance No. 92 -13
at its meeting of April 27, 1992
consisting of amendments to Sections
5.04.030 and 5.04.105, as well as the
addition of Chapter 5.95 to the Code
which will regulate the operation of
short term lodging through regulatory
means. The proposed amendment to Title
5 was passed to second reading and
adopted on May 11, 1992. The proposed
amendment to Title 20 of the Municipal
Code will serve as a reference to Title
5, and will add an additional
enforcement mechanism to the overall
regulatory scheme.
Hearing no one wishing to address the
Council, the public hearing was closed.
Motion was made to adopt Ordinance No.
92 -24.
E. PUBLIC COMMENTS:
1. Douglas Boyd, 2101 E. Balboa Boulevard,
Treasurer of the Committee to Limit
Council Terms in Newport Beach, stated
that petitions are currently being
circulated to place this issue on the
November ballot; however, if the Council
were to initiate the Charter Amendment,
considerable tax dollars would be saved
at the time of election.
Deborah Allen, 1021 White Sails Way,
representing Corona del Mar Resident's
Association, stated their goal is to
give input to the City Council on issues
affecting Corona del Mar, and therefore,
invited Council Members to attend their
next board meeting on Thursday, May 28
at 7:30 a.m., when they will discuss
height limits in Corona Highlands, and
front yard wall limits and rear yard
setbacks for Corona del Mar.
Lucy Harrison, 2720 Harbor View Drive,
addressed the Council in ooposition to
the five speed bumps recently installed
on Harbor View Drive. She stated she
was unaware of who initiated the work,
and that she never signed a petition
supporting the bumps. She stated it was
very "irritating" to find out that other
homeowners on the street were able to
"lobby this thing through" and
suggested, that in the future the City
spend the money on education rather than
road bumps.

Linda Lumsden, 603 Carnation Avenue,
stated that over one year ago she
circulated a petition requesting speed
bumps on Carnation Avenue, and as of
this date, 748 are in favor. She has
discussed this matter with the Mayor and
City Manager, and would like to see the
City proceed with the work as soon as
possible.
Victoria L. Pena, 617 Carnation Avenue,
spoke in opposition to the proposed road
bumps on Carnation Avenue, stating she
was never approached to sign a petition
either for or against. As a result, she
contacted 93 homes on Carnation Avenue,
of which 44 of the residents were not
home; 32 homeowners are against the road
bumps; 9 homeowners are in support; 2
were undecided, 5 residences unoccupied,
and one residence unreachable. She
stated that in essence, 728 of the
residences are in opposition to the road
bumps. She also stated that she thought
it would be "wise and prudent" in the
future to notify affected homeowners in
advance of any proposed issue so that it
can be voted on by those individual
property owners.
Linda Lumsden, 603 Carnation Avenue, in
rebuttal to the above speaker, stated
that the affected area where road bumps
are being considered is between 2nd and
4th Streets only, which consists of 52
residences between those two blocks;
therefore, she felt the above figures
were inaccurate, and that the correct
figures can be verified with the Traffic
Engineer.
The City Manager advised that he has
reviewed the City's current policy with
respect to road bumps, and referenced
the petition method of procedure
enumerated in said policy. He stated
that, inasmuch as there is a difference
of opinion among the homeowners on
Carnation Avenue as well as Highland
Avenue, he would recommend a mailer be
sent to the affected homeowners
explaining the advantages and
disadvantages of road bumps, together
with a postcard to be returned to the
City as to whether or not they desire
road bumps on their street. The mailers
would be sent to the property owners
directly. He also felt that the entire
issue of road bumps should be revisited
again, and stated a report will be
coming to the City Council. With regard
to the road bumps already installed on
Harbor View Avenue, he indicated that
mailers /postcards would also be sent to
those affected homeowners.

staff review again the proposed speed
bumps on Carnation and Highland Avenues,
as veil as the road bumps already
Installed on Harbor View Avenue, to
determine if the petitions received
conform with the City's current policy
on road bumps, and 2), bring the policy
back to the City Council at the next
study session or evening meeting so that
it may be discussed comprehensively to
determine if the policy should be
modified or eliminated.
