DATE: April 26, 1993 ROLL CALL Reading of Ninutes of the Meeting of April 12, 1993, was waived, approved as written, land ordered filed. Reading in full of all ordinances and resolutions under consideration was waived, and City Clerk was directed to read by titles only. PUBLIC HEARINGS Mayor Turner opened the public hearing concerning proposed ORDINANCE N0. 93 -3, being, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING TITLE 20 OF THE NEWPORT BEACH NUNICIPAL CODE AMENDING DISTRICTING NAP NO. 3, SO AS TO ESTABLISH A 2.85 FOOT FRONT YARD SETBACK ON 3 LOTS FROM THE EXISTING 10 FOOT WIDE CLUBHOUSE AVENUE EASE11ENT ADJACENT TO THE BULKHEAD ON THE RIVO ALTO CHANNEL. (PLANNING COMMISSION AMENDMENT NO. 775). Request to amend a portion. of Districting Map No. 3, which currently designates a 3 foot front yard setback from the original front property lines, prior to the abandonment of a portion of the street right -of- way; on property located at 400, 400 -1/2, and 402 Clubhouse Avenue. Report from the Planning Department. The City Clerk advised that after the agenda was printed, a letter from the property owners of 402 Clubhouse Avenue was received in support of the proposed ordinance. In addition, a letter was also received from the owner of 406 Clubhouse Avenue opposing any encroachment into the existing right -of- way on Clubhouse Avenue. The Planning Director noted that the property owners of 400 -1/2 Clubhouse Avenue have requested that the City amend Districting Map No. 3 so as to change the front yard setbacks of the 3 lots in question, taking into consideration the abandonment of approximately 24 feet of right -of -way of Clubhouse Avenue that was approved by the City Council in 1957 and 1958. The proposed change will allow structures to be built to within 12.85 feet of the bulkhead line, or 2.85 feet from the existing 10 foot wide Clubhouse Avenue easement on property located at 400 -1/2 and 402 Clubhouse Avenue. This request was unanimously approved by the Planning Commission on March 18, 1993. The Planning Director also noted that • with regard to the letter referenced earlier by the City Clerk from Myra Kirschenbaum, property owner of 406 Clubhouse Avenue, approval of the proposed amendment is exactly what she has indicated in the third paragraph of her letter and, in essence, she is not opposing this request. Fleetwood Joiner, architect for this project, addressed the Council and stated he was available for questions. Hearing no questions, and no one else wishing to address the Council, the public hearing was closed. Motion x Motion was made to adopt Ordinance No. All Ayes 93 -3. 2. Mayor Turner opened the public hearing regarding GENERAL PLAN AMENDMENT NO. 92- 2(C) - Request to amend the Land Use Element of the General Plan so as to revise the area description for BAYVIEQ LANDING to incorporate additional language required by the California Coastal Commission in the certification of Local Coastal Program Amendment 3 -92; • AND LOCAL COASTAL PROGRAM AMENDMENT NO. 28 - Request to amend the Local Coastal Program Land Use Plan so as to revise the area description for BAYVIEV LANDING to incorporate additional language required by the California Coastal Commission in the certification of Local Coastal Program Amendment 3 -92. Property located at 951 Back Bay Drive, on the northwesterly side of Jamboree Road between Back Bay Drive and East Coast Highway, across from the Villa Point Planned Community. Report from the Planning Department. The purpose of the proposed amendments were summarized by the Planning Director as set forth in the staff report. Hearing no one wishing to address the Council, the public hearing was closed. Motion x Motion was made to adopt Resolution No. All Ayes 93 -19 adopting General Plan Amendment 92 -2(C); and adopt Resolution No. 93 -20 adopting Local Coastal Program Amendment • No. 28 for the Bayview Landing site; and direct staff to resubmit the documents necessary to certify the LCP, Land Use Plan amendment by the California Coastal Commission. Mayor Turner opened the public hear ingg CDBG /HUD regarding Amendment of the 1992 -93 (87) COMMUNITY DEVELOPMM BLOCK GRANT (CDBG) Final Statement, Application for a Department of Housing and Urban Development (HUD) Section 108 loan and the Proposed "Statement of Community Development Objectives and Proposed Use of Funds" for the CDBG program, 1993 -94 Fiscal Year. Report from the Planning Department. The City Clerk advised that after the agenda was printed, a letter was received from Cindy Goebel in support of the project proposed by Tustin Avenue Partners. The Planning Director advised that the subject application is being presented in two separate actions; 1) Amendment to the 1992 -93 CDBG Final Statement, Application for a HUD Section 108 Loan on property located on Tustin Avenue; and 2) Proposed Statement of Community Development Objectives and Proposed Use of Funds for 1993 -94. Craig Bluell, Principal Planner, summarized the two -part application as enumerated in his report and answered questions of the Council. Council Member Sansone stated he would like to defer action on the portion of • the hearing relating to the affordable housing project proposed by Tustin Avenue Partners, as he is opposed to approving a $450,000 loan without additional justification. He commented he would like to see a financial report with the same type of information as a bank would require for a loan of this magnitude. Council Member Hart stated that she also has some serious reservations regarding the proposed affordable housing project, and concurred in deferring action on this item until additional information is provided by the staff. In response to question raised by Mayor Turner, Mr. Bluell stated that the City has a provision which is included in all affordable housing agreements whereby if any developer fails to perform on the subject property, it then becomes the property of Newport Beach. John McCray, partner in Tustin Avenue Partners, addressed the Council and advised that he will provide to the staff whatever financial information is deemed appropriate prior to the neat • Council meeting. Motion x In view of the foregoing, motion was All Ayes made to continue the public hearing on the affordable housing request of Tustin Avenue Partners to May 10, 1993. Volume 47 - Page 74 CITY OF NEWPORT BEACH COUNCIL MEMBERS S' April 26, 1993 ROLL Cf3LL MINUTES millf0 The following persons addressed the Council in snonort of their request for funding of social services: Robin Jaruszewski, representing Interval House Crisis Shelter for • battered women and children, stated that every 15 seconds a woman is being battered, and that the funds they receive would be used to help buy materials and fixed furnishings for the completion of the expansion of the existing second stage shelter. Judy Mackel, representing Assessment and'Treatment Services Center (ATSC), Santa Ana, stated they are a youth counseling agency and celebrating their 19th year of serving the youth in five cities of Orange County; the children from Newport Beach are referred to them by the Newport Beach Police Department and Newport Mesa Unified School District; no fee is charged to recipient; and they would appreciate the City funding their organization; however, they are not being recommended by staff for funding this year. Mr. Bluell stated that ATSC has been funded twice in the past, but they are not being recommended for funding this year, inasmuch as they have not complied • with the funding reporting requirements; their organization is classified as a third - priority type service; and the City is already funding the Center for Creative Alternatives which is a similar type program. In response to question raised by Council Member Watt regarding the request of Human Options, Mr. Bluell stated that the City funded this organization for three consecutive years; however, over that period of time, they only assisted one resident from the City of Newport Beach. During this current year, they have not assisted any residents of the City, and it is the City's goal to provide financial assistance to those social service groups who provide direct assistance to City residents. In response to question raised by Council Member Hedges relative to auditing of the CDBG applications, Mr. Bluell stated that staff audits all the applications and the organizations are monitored on an annual basis by a consultant who does on -site visits. • Susan Oakson, Director of the Homeless Issue Task Force, expressed appreciation to the City Council for previous support of their program and stated she was available for questions. She described their programs and stated that 56% of their clients are from Newport Beach. They do need volunteers to assist in delivering meals to shut -ins as they serve 48 people a day. Hearing no others wishing to address the Council, the public hearing was closed. Council Member Hart advised that she will abstain from voting on this matter inasmuch as she serves on the Board of Directors of the YMCA and the Center for Family Counseling. Motion was made to adopt Resolution No. Res 93- X X X X 93 -21, and authorize the City Manager to X submit the 1993 -1994 CDBG Final Statement, including all understandings and assurances contained therein, and to act as the official representative of the City in connection with all submission and application and to sign contracts with appropriate subagents to carry out programs in the approved budgets. PUBLIC COMMENTS Council Member Hedges commented on the recent lawsuit filed by Everett Temme, Jr., for Deprivation of Civil Rights and Demand for Jury. Recycled report from the Acting Chief of Police, dated April 22, 1993. Acting Chief of Police Jim Jacobs, addressed the Council in support of his request to close the beaches at 10 p.m. for the reasons set forth in his report. He stated that most of the police related problems on the beach occur in the late evening hours after beach closure, and he felt the City should keep the curfew similar to other neighboring beach cities. In response to question raised regarding the feasibility of providing special permits to City residents for after - curfew hours on the beach, the City Attorney stated that when there is the involvement of public property, the City Council cannot give special privileges to residences of the City of Newport Beach which cannot be given to other members of the general public, and on this particular issue, he cannot see a rational basis for distinguishing between the public and residences of Newport Beach. The following persons addressed the Council in oyyosition to the proposed 10 p.m. beach closure: Kendall Jacobson, 120 Diamond Avenue, Balboa Island, stated that the beach should not be "taken away" from local residents, and that the City of Huntington Beach is different from Newport Beach in that they have fire rings. Peter Beck, 2101 Seville, Peninsula Point, stated he has talked with over 40 homeowners in the area and only three were in favor of the proposed beach closure. He would like to be able to enjoy a walk along the beach at night and not be cited. He urged that this item be continued for additional information. Coast PB &R /Beach Highway, stated he enjoys jogging Curfew and walking along the beach as well as surfing, and would hope that the 11 p.m. current curfew remain. • The following persons addressed the Council in suvvort of the proposed 10 p.m. curfew:' Dayna Pettit, 1741 Plaza Del Sur, President, Balboa Peninsula Point Association. Fred Thompson, 124 E. Bay Avenue, President, Central Balboa Homeowners Association. Val Skoro, owner of property at 107 Highland Avenue. Bill Schonlau, President, West Newport Beach Association. Council Member Hedges read into the record the following prepared statement regarding this issue: "The telephone calls which broke the serenity of this beautiful sunny morning caused me once again to contemplate how readily we as a free people seem willing to surrender our freedoms. The calls were in response to Newport Beach Council Member Evelyn Hart's reported • misgivings of the proposed 10 p.m. beach closing. She was quoted as not willing 'to live in fear in my city. That's no way to live.' "Indeed. A very small minority of the population commits those acts which we try to prevent. Because of our fears (misplaced or otherwise) we enact more and more rules to 'protect ourselves.' Those various laws and ordinances that we pass as we strive to regulate human behavior all chip away at our freedom to be free. Thomas Sowell in a recent Register editorial on personal freedoms related the old story about the way to cook a frog. One should heat the water slowly until boiling. Otherwise, the hapless creature would surely notice the rapid heat increase and jump for his life. Similarly so with our own pot of water within which we reside. It's warm now as we continue to turn up the heat on those 'bad guys' who are in the pot with us. "Many people live in fear of the nameless, faceless, and omnipresent bogeyman who lies in wait to destroy our way of life and take away those things • which are dear. In kneejerk reaction we respond by proposing to erect taller and wider barriers against those who would invade us. The 'other communities are doing it, so we must, too' argument is waved like a battle flag in our rush to 'protect ourselves.' The constitutional right of equal protection which requires all laws to be applied the same causes the law - respecting citizen to suffer most. Those who intend to commit • mischief will do so regardless of the hour. We also miss the point that our zeal to prevent the destruction of our way of life causes us to fall victim to accomplishing that same end by our own collective hand. The incremental effect of small changes means that we just don't realize it so quickly. "The issue of the 10 p.m. beach closing itself is admittedly a relatively minor one. But it is one more ratchet downward in the tightening vise of the loss of our freedom to be ourselves and to enjoy our own communities." Motion x In view of the foregoing, motion was made by Council Member Hedges to table the proposed ordinance. Council Member Hart also expressed her reasons for opposing the closing of the beach at 10 p.m., indicating, in part, how much she enjoyed the beach in the early morning and late evening hours. Motion x Mayor Turner stated he does not support the motion to table the proposed ordinance; the State has chosen to close their beaches at 10 p.m., as well as • other beach cities taking similar action, and he felt the City of Newport Beach should follow suit. He therefore, moved a substitute motion to adopt Ordinance No. 93 -6. Ayes x x x x x The substitute motion was voted on and Noes x x carried. CURRENT BUSINESS 23. Report from the Public Works Fees /Pkg Department /Traffic Engineering (40/85) concerning proposed resolution for ANNUAL PARKING PERMIT FEE. Rich Edmonston, Traffic Engineer, noted that the Annual Permit allows parking in the two beach parking lots and at blue - pole meters in various locations throughout the City. There are approximately 2000 permits sold each year. He submitted the following two alternatives for consideration: (a) Adopt a resolution increasing the fee for the Annual Parking Permit from $68 to $78; OR (b) Adopt a resolution increasing the fee for the Annual Parking Permit from $68 to $100. The City Attorney advised that he had been contacted by Mr. Campbell's legal counsel that afternoon stating he was unable to attend this meeting, and requested this item be deferred to May 10, 1993. Motion x Hearing no objections, motion was made All Ayes to defer this item to May 10, 1993 as requested. 25. Report from the Public Works/Traffic Engineering regarding PASSING METER OPERATIONS. A Supplemental Report from the Traffic Engineer regarding Seashore Drive Permit Parking was also presented. It was recommended the City Council take the following actions: (A) Direct staff to proceed with the following changes to the parking meter program: • 1. Increase meter rates: (a) All $.50/hour meters to be increased to $1.00/hour; (b) All $.75/hour meters to be increased to $1.00/hour; (c) The $.25/hour meters in the following recreational areas to be increased to $1.00/hour: 15th Street; 18th Street; 19th Street; the east side of the northbound lanes of Newport Boulevard between 26th and 30th Streets; and West Newport Park. 2. Extend the hours of operation of all meters from 6 p.m. to 8 p.m. 3. Install $1.00/hour meters along the north side of Seashore Drive between 54th and Summit Streets. Reduce the number of blue - pole meters in the Ocean Front and Las Arenas Beach Lots by 108. (B) Authorise the necessary expenditures to implement the above changes. Council Member Debay referenced recommendation No. 3 in the foregoing, and stated it is the desire of the residents in that area to start the meters at 56th Street rather than 54th Street, to which the Traffic Engineer stated is an option. She also spoke in support of implementing some type of visitor parking permit program for Seashore Drive residents similar to what is being used on Newport Island. Doug Boyd, 2101 E. Balboa Boulevard, addressed the Council and spoke in favor of charging the same meter rates as does the State; and also suggested some type of parking relief be provided at the Balboa Branch library on Saturdays. Val Skoro, owner of property at 107 Highland Avenue, addressed the Council and concurred in the recommendation of Council Member Debay to implement a guest parking permit program for the Seashore Drive area. Bill Schonlau, President, West Newport Beach Association, addressed the Council and suggested that whatever fee policy the Council ultimately approves, that policy be consistent throughout the City for residential as well as commercial areas. Council Member Hart spoke in opposition to recommendation No. 2, stating she did not think it would be in the best interest of the City to extend the hours of the meters to 8 p.m., as many people have a tendency to forget to feed a meter after 6 p.m.; also most tourists leave the City by 6 p.m.; and the City should support its businesses by keeping the hours of operation of all meters at 6 o.m. Motion was made by Council Member Hedges to approve the recommendations as set forth in the foregoing and subject report.
