Recommendation (b) of Item #3 (Approval and Award of Professional Services Agreement with
Avenu Insights and Analytics, LLC for Sales and Use Tax Auditing Services) pertains to an
agreement that required modification after the Staff Report for this item was published before the
August 13, 2019 City Council Meeting.
Section 1 ("Term") of the agreement was slightly modified. While the contract retains the original
termination date of June 30, 2024, the revised version clarifies that the contract engagement shall
be considered in five, one-year terms rather than a single term of five years. This distinction is
important for contract administration and enforcement purposes and encourages more regular
review of the contractor's performance and deliverables.
Section 4 ("Compensation") of the agreement was changed, from $525,000 to $531,000. This
correction was made in order to properly reflect an annual Consumer Price Index increase related
to Sales & Use Tax Analytics ("Clearview"), Reporting and Forecasting, as well as additional
consulting services for which the City may engage the Consultant on an hourly fee basis, as
indicated in Exhibit B.
The Staff Report corresponding with this agreement already reflects the items described above.
However, the agreement attached to the Staff Report has been modified to match the requests in
the Staff Report.
