Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Lucie Delorme, Administrative Analyst, Idelorme(o-).newportbeachca.gov PHONE: 949-644-3394 TITLE: Resolution No. 2019-88: Certifying Funding Listed in the Federal Transportation Improvement Program (FTIP) ABSTRACT: The Federal Transportation Improvement Program (FTIP) is the primary means of implementing the Regional Transportation Plan through the Orange County Transportation Authority (OCTA) and includes regionally significant projects funded with State and Federal funds. The base FTIP is updated every two years and the 2021 FTIP covers Fiscal Years 2020-21 through 2025-26. OCTA requires the City adopt a resolution certifying that funding listed in current and future City projects is available and committed. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution 2019-88, A Resolution of the City Council of the City of Newport Beach, California, Certifying that the City of Newport Beach has the Resources to Fund the Project in the Federal Transportation Improvement Program for Federal Fiscal Years 2020/21 — 2025/26 and Affirming its Commitment to Implement the Project. FUNDING REQUIREMENTS: Sufficient funding is available in the current Capital Improvement Program budget for the Newport Beach Bicycle and Pedestrian Bridge (Superior Avenue Overcrossing/Parking Lot) Project, the one approved City project listed in the FTIP. 3-1 Resolution No. 2019-88: Certifying Funding Listed in the Federal Transportation Improvement Program (FTIP) October 8, 2019 Page 2 DISCUSSION: The FTIP is a listing of all capital transportation projects proposed over a 6 -year period. Projects include highway improvements, transit, rail and bus facilities, high occupancy vehicle lanes, signal synchronization, intersection improvements, freeway ramps, bike facilities, etc. The OCTA FTIP database includes all projects that are deemed regionally significant, regardless of the funding source and allows local agencies access to view and amend their projects. As part of the 2021 FTIP update, OCTA requires local jurisdictions to adopt a Resolution affirming the City's intent to allocate resources to fund and implement federally funded projects. Currently, the City has one approved improvement project listed in the FTIP. OCTA approved the Newport Beach Bicycle and Pedestrian Bridge project through the Bicycle Corridor Improvement Program (BCIP) with a 20% minimum City match. Newport Beach Bicycle and Pedestrian Bridge Project — This project, also known as the Superior Avenue Overcrossing/Parking Lot Project (15T09), will provide bicycle and pedestrian access across Superior Avenue to and from Sunset Ridge Park. This project is currently included within the approved FY 2019-20 Capital Improvement Program Budget (Page 51). FTIP Project Funding Summary Project Construction Cost Estimate Funded by Grant Funded by City Newport Beach Bicycle and $2,937,000.00 $2,349,600.00 $587,400.00 Pedestrian Bridge Project ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2019-88 3-2 ATTACHMENT A RESOLUTION NO. 2019-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, CERTIFYING THAT THE CITY OF NEWPORT BEACH HAS THE RESOURCES TO FUND THE PROJECT IN THE FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM FOR FEDERAL FISCAL YEARS 2020121 — 2025126 AND AFFIRMING ITS COMMITMENT TO IMPLEMENT THE PROJECT WHEREAS, the City of Newport Beach ("City") is located within the metropolitan planning boundaries of the Southern California Association of Governments; WHEREAS, the City Council for the City has authorized a submittal to the 2021 Orange County Transportation Authority ("OCTA") Federal Transportation Improvement Program ("FTIP") for the Newport Beach Bicycle and Pedestrian Bridge project, which is currently approved in the FTIP; WHEREAS, by adopting this resolution, the City Council intends to certify that the City has the resources to fund the project in the FTIP and affirm its commitment to implement the project in the FTIP; WHEREAS, the City is the lead agency for the project submitted by the City in the FTIP and will comply with applicable local, state, and federal provisions for the project, including but not limited to the FTIP, California Environmental Quality Act, National Environmental Policy Act, Americans with Disabilities Act, and Buy America; and WHEREAS, City intends to agree to construct "Transportation Control Measures" for its project in the FTIP, as noted in the FTIP 2020121 — 2025126 Guidelines, as amended, in a timely manner. NOW THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby certify that the City has the resources to fund the project in the FTIP and affirm its commitment to implement the project in the FTIP. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 3-3 Resolution No. 2019 - Page 2 of 2 Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to CEQA pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
