Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Kathryne Cho, Civil Engineer, kcho@newportbeachca.gov PHONE: 949-644-3014 TITLE: 2018-2019 Facilities Painting Project — Notice of Completion for Contract No. 7499-1 (18F02) ARSTPArT- On March 26, 2019, the City Council awarded Contract No. 7499-1, 2018-2019 Facilities Painting Project, to Tony Painting (Tony) of Garden Grove, California. The work has now been completed and staff requests City Council acceptance and closeout of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and c) Release the Faithful Performance Bond two years after acceptance by the City Council. FUNDING REQUIREMENTS: The adopted budget included sufficient funding for this project. A majority of the work included the rehabilitation of Utilities Department pump stations, recreational facilities, and the Central Library. The City received a 2 -year warranty that covers peeling, blistering or chipping paint resulting from defective workmanship. The 2018-2019 Facilities Painting Project was awarded to Tony on March 26, 2019 with a Notice to Proceed date of May 6, 2019. The contract has been completed to the satisfaction of the Public Works Department. A summary of the contract cost is as follows: Original Bid Amount: $ 398,700.00 Actual Cost of Bid Items Constructed: $ 395,830.00 Total Change Orders: $ 30,255.00 Final Contract Cost: $ 428,955.00 Staff issued three change orders and the final construction cost was 7.6 percent over the original contract amount. The additional cost covered requested painting needs for the Marina Park event room and restrooms, seven Oasis Senior Center classrooms, and some Big Canyon Reservoir piping. Based on positive feedback from City staff on the quality of completed scheduled work, staff included these additional locations after the project started. Estimated Completion Date per 2019 Baseline Schedule: January 31, 2020 Project Award for Construction: March 26, 2019 Contract Completion Date with Approved Extensions: October 20, 2019 Actual Substantial Construction Completion Date: September 13, 2019 7-2 2018-2019 Facilities Painting Project — Notice of Completion for Contract No. 7499-1 (18F02) November 5, 2019 Page 3 ENVIRONMENTAL REVIEW: On March 26, 2019, City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 Class 1 (maintenance of existing facilities involving no expansion of an existing use) of the CEQA Guidelines, because this action will not result in a physical change to the environment, directly or indirectly; NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
