SUBJECT: Renewal of Legislative Advocacy Contract with
Kenneth Emanuels and Associates
BACKGROUND
For the past two years, the City has retained Kenneth Emanuels & Associates to
provide legislative advocacy and support in Sacramento. As our lobbyist, Mr.
Emanuels led the City's efforts on a number of City -sponsored bills. In 1996, four
bills were introduced on the City's behalf. Three of these were ultimately resolved
administratively through Mr. Emanuels negotiations with State officials.
• Local Coastal Boundary Adjustments: State legislation was introduced to
change the Coastal Zone boundary. The bill was withdrawn after Coastal
Commission staff agreed to meet the City's objectives administratively rather
than legislatively.
• Non -Resident Library Fees: The proposed legislation would have allowed
cities to charge a non-resident fee without losing State funding. The bill died
in the Senate Education Committee.
• Methane Gas Mitigation: A bill was introduced that would have provided
State funds for methane gas mitigation. The bill was withdrawn after
Caltrans agreed to provide up to $750,000 to mitigate the methane gas hazard
around Hoag Hospital.
• Bay Discharge Legislation: In response to the proposed IRWD water
reclamation project, this bill would have prohibited discharge of reclaimed
water within two miles of any bay or estuary. The bill was withdrawn after
IRWD and the City reached a settlement agreement.
The City's 1997 legislative agenda was as challenging as 1996. Two bills were
introduced that were ultimately signed into law.
• Beacon Bay: Successfully amended the Beacon Bay Bill to revise the revenue
allocation requirements.
• Police Videotape Storage Requirements: AB 820 was signed into law
decreasing the time requirement to store police department videotapes.
• Upper Newport Bay Dredging Funds: By far, the most successful effort was
the approval of $2 million in the State budget to partially fund the Upper
Newport Bay dredging project.
• Library Legislation: Continued to pursue administrative and legislative
changes to defray costs associated with non-resident library use. The State
Library Board ultimately agreed to become more involved in resolving the
non-resident imbalance issue.
In 1998, the following issues are expected to require legislative advocacy and support
in Sacramento:
• U112er Newport Bay Dredging Funds: Another $3 million is needed to
complete the Unite III dredging project.
• Marinapark Tidelands: State Lands Commission will be providing their
opinion on the Marinapark tidelands boundary study within the next month.
If the Commission rules that Marinapark is within tidelands, it is expected
that some State legislative activity will be necessary, depending on the City
Council's final action on the future of Marinapark.
The City's contract with Kenneth Emanuels & Associates terminates February 28,
1998. Attached is a new 12 month contract, at a fee of $3,000 per month. This is the
same monthly retainer as last year. The contract also provides for reimbursement
for direct costs incurred by the consultant, such as telephone, travel, etc.
On Friday, January 23, 1998, the City Council's Legislative Committee unanimously
voted to recommend that the City Council approve the attached contract with Ken
Emanuels for legislative advocacy in Sacramento.
RECOMMENDED ACTION:
Authorize execution of a one-year agreement for professional services with
Kenneth Emanuels and Associates for State legislative advocacy services, not to
exceed $40,000 annually beginning March 1, 1998.

AGREEMENT
This agreement made and executed at Newport Beach, California, effective March 1, 1998, by and
between the City of Newport Beach, hereinafter called CITY, and KENNETH J. EMANUELS, d.b.a.
KENNETH EMANUELS & ASSOCIATES, hereinafter called CONTRACTOR.
WITNESSETH:
The City hires the Contractor and the Contractor agrees to work for the City on the following terms and
conditions:
The duty of the Contractor shall be to provide consulting services as a lobbyist on pertinent municipal
matters on behalf of the City. The Contractor shall be responsible for the advancement of a limited number of
city -sponsored legislative proposals.

The Contractor shall certify that employees and/or entity are properly registered, licensed or certificated
pursuant to law to perform the task set forth hereunder.
III
The City shall pay to Contractor for the twelve-month period from March 1, 1998 to February 28, 1999
payable at the rate of $3,000 per month, billed monthly in advance, for time spent by Consultant in the
performance of this agreement. The Contractor's direct costs for telephone, duplication, postage, legislative
computer and bill service and required travel will be reimbursed by the City.
IV
It is understood that the City will not be responsible for any obligations of an employer. Specifically, the
Contractor shall furnish his own means of transportation when not required by the City to travel, miscellaneous
supplies, and incidental expenses. It shall be understood that the Contractor shall not incur any additional
expenses on behalf of the City.
V
The Contractor shall report his lobbying activities as required by the California Fair Political Practices Act
and Commission (California Code of Regulations, Title 2, Chapter 6 and Title 2, Chapter 7).
