CITY CSF NEWPORT BERG MAR - 9 I: Begin the 30 -day review period for actions required of Fletcher Jones Motorcars Schedule evaluation of lighting improvements and consideration of final certificate of occupancy for April 13, 1998 The City Council approved an action plan for the lighting issues at Fletcher Jones Motorcars on February 23, 1998. The Council also directed staff to begin a 30 -day review period after implementation of all items in the action plan, and to withhold the final certificate of occupancy until all mitigation measures and conditions of approval are met. The General Manager of the dealership appeared at the meeting, and requested that the review period begin upon completion of the items required of Fletcher Jones, and that the final certificate of occupancy be issued at the end of the review period if the lighting improvements are found to satisfy the mitigation measures and conditions of approval. He has followed up that request with the attached letter, which notes that the off-site landscaping is out of Fletcher Jones' control and should not be a condition of the final certificate of occupancy. The neighborhood representative appearing at the City Council meeting indicated that the residents wish the review period to begin after the landscaping is installed, and the final certificate of occupancy to be held until the complete action plan is implemented and found satisfactory. This request was followed up with a telephone call to staff emphasizing the importance of this position to the residential neighbors. As of February 23, the only outstanding item for which Fletcher Jones is responsible was modification to the interior lights. Staff has verified that incandescent lights have been installed to replace the specified metal halide lights, and that the automatic control has been installed to ensure the change from metal halide to incandescent at dark. I have continued to work with the landscape architect, and I am confident that a landscape plan will be prepared by March 27, 1998, as indicated in the action plan. A schedule for installing irrigation and plant materials is not yet available. The landscape architect has advised that the types of plants that must be used in the saltwater marsh area are generally available only in smaller sizes. In addition, she recommends that smaller size plants be used to allow the root structure to develop and mature, helping to ensure the longevity of the materials. The plants in this area may require three to five years to develop and fill in. Because the landscaping will take longer to be installed and, in some cases, to develop and fill in, because this aspect of the action plan is outside of Fletcher Jones' control, and because Fletcher Jones has completed all items required of the dealership, staff is now recommending that the 30 - day review period begin immediately. If the City Council approves this approach, staff will provide an evaluation of the improvements on April 13, 1998, with a recommendation regarding issuance of the final certificate of use and occupancy. O. ox 1768 Newport each, CA 92659-1768 Dear Kevin: In response to last night's City Council meeting, Fletcher Jones Motorcars would like to propose that the final mitigating factor, namely the landscaping, which is off-site and, therefore, not within our control, should be removed from any conditions for the Final Certificate of Occupancy. Fletcher Jones Motorcars has acted in the spirit of cooperation and good neighborliness and has met all of the lighting conditions outlined in Sharon Wood's report dated February 20`h. I, therefore, request that this final mitigating factor be removed at the next council meeting and that the 30 day review period commence. Thank you for your prompt attention to this matter.
