To be clear, the residents do not dispute the benefits of bicycles( including motorized ones) as a potentially valuable substitution for cars, for transportation purposes. Motorized bikes can certainly be used on Roadways designed for vehicles,where they offer compatible speed and alternative to cars for off -freeway application. Furthermore, we are in full support of legitimate physically handicapped individuals being able to enjoy the oceanfront boardwalk consistent with non -handicapped walkers, bicyclers,skaters. They are welcome to use legitimate transportation aids to have access. What we have at issue on the boardwalk is a Safety issue—not only with motorized bicycles, but also the numerous other varieties of motorized uses—skateboards,scooters, etc( 12 varietals at recent count). It is not only the speed inherent in the use of a motor; it is also the hazards associated with stunts, and limited ability to steer/maneuver or stop . Residents and visitors who want to enjoy the healthful ,aesthetically pleasing ocean environment should be able to walk, run, bike,skate on the boardwalk without fear of getting hit and injured. This is not feasible with the current state of affairs. The addition of more boardwalk "capacity" does not solve the problem, and will likely exacerbate it. The Council asked for Solutions. Here they are: • Prohibit Motorized Uses on the oceanfront boardwalk. • Only Exception: Individuals with Certification of physical handicap should be allowed to use approved legitimate types of mobility apparatus: wheelchair, electric bike with governor. (such permits can be obtained from the City, should an individual not have a Handicap designation on other form of identity,eg. Drivers license or other). An individual merely be required to carry this on person, just like one is required to carry a drivers license when driving). • Penalties: Staff indicated that the City ordinance currently contains "penalties". Penalty needs to be first and foremost, Citation with Fine- Fines to be at level that gets people's attention,eg. $250-. Additional fine can be levied for Hazardous operation of ANY use on the Boardwalk. • Enforcement: Getting the Message Out takes competent PR -Newport Beach should be a Active Lifestyle/Health brand. • Continued enforcement requires only a couple of bicycle PD to go up and down boardwalk and issue citations. Alternately,or in conjunction, outsource parking enforcement can take this on, with similar contract to that vendors have for parking meter management. If Citations are given , the word will get out quickly. Enforcement should include fines for uses operating which are already not allowed on the boardwalk in NBMC, and also for hazardous operation of any use. • Boardwalk signage -Currently, Boardwalk signage is inconsistent in nature, and has NO indication of any Penalty. Citation and Fine( with amount_ should be included. With clear signage, NBPD indicates that they are comfortable to enforce. • Curtail operators of Segues and other motorized uses, at least on the boardwalk. Electric bikes can use the roads, and people can walk them across the boardwalk, OR the bike motor can be turned off. The most important investment to make this successful is that of Political Will to do the right thing. We greatly appreciate your consideration. I see you have an agenda item to discuss electric bikes on oceanfront. My wife and I have pedigo bikes and have been riding the boardwalk for many years. While traveling on the boardwalk we have the ability to know our speed which is nice. We never exceed the speed limit. I will say that we have seen abusers. Punish the abusers be it electric bikes, scooters, racing 10 speed bikes seem to be the worst and they are not even motorized. They say a few bad apples ruin for all and I feel like if you do not allow electric bikes at all that would ruin our bike riding route. Thanks and I support to leave it as is and enforce the 8 mile an hour speed limit. I cannot attend but I wanted to share my thoughts as it's been an issue for some time now. My sisters dog was actually hit by a man on an electric bike. He was speeding around them on the boardwalk and took it too close. The dog was ok but my sister was terrified and I was very irritated when she told me. Since her incident I have thought a lot about solutions. I am not sure a hard ban is the answer but I do think law enforcement should at least step in and start citing speeders. It says "8mph" already ... I think some tickets would change behavior. I have myself shopped, dined and noticed things that I wouldn't had I walked or had I driven. I'd like to mention that I am an owner of an electric scooter. It provides a different perspective and it is quite enjoyable. I do however agree with the council withdrawing Bird and Lime scooters. I believe we should not allow any motorized vehicle to operate on the Boardwalk. I've seen many near misses between pedestrians and motorized bicycles. We have many pedestrians that are distracted by the beautiful views and conversing with their friends or on the phone. Unfortunately there are many riders that chose to ride at too fast a speed endangering all the other users of the Boardwalk. We live in Newport Shores and use the boardwalk four times a week. Electric Bikes and other motorized modes of transport should not be allowed on the boardwalk. I feel the streets have adequate bikes lanes for these "motorized vehicles". Most go over the BMPH speed limit and My guess is some pass us at 20mph. And to that, lots of people use these electric bikes for surfing with metal tubes protruding out next to the bike. This makes them even wider, increasing the chances of an accident. As time passes these bikes will become less expensive and more popular. We have not noticed any crashes yet but have seen lots of close calls. It is only a matter of time before we witness a bad crash. The summer crowds on the broad walk do self regulate the electric bikes. We also notice large groups of tourists on them. So maybe the rental companies need to educate their clientele better. My wife and I both growing up here and being current residents feel no motorized vehicles should be allowed on the boardwalk as the signs state. This means electric bikes, hoverboards, single wheeled electric vehicles, electric scooters & electric skateboards. All of which we have seen on the boardwalk. The battery powered scooters, bikes, etc. are now offered for rent at the base of Newport Pier as well as the privately owned battery powered vehicles used by many visitors. They are a danger to pedestrians and a huge liability for the city. Battery powered vehicles are a hazard to everyone on the Oceanfront Boardwalk and they should be banned from Newport Beach. We need a periodic task force to ticket the violators, enforce the rules, and remove this danger to the public. Thank you. Allowing electric bicycles on the boardwalk is a huge safety hazard for everyone including walkers, runners, toddlers, babies in strollers, bicyclists, people pulling wagons loaded down with beach paraphernalia crossing the walk to get to the sand. When we see or hear that whir of an electric bike we stop and step off the walk. It's like when there is snowboarder coming down the mountain behind you. You can hear them coming but do not know if they're going so fast they won't be able to dodge you. Awful feeling of dread. We would like to see these motorized bicycles banned on Oceanfront boardwalk. If you chose not to take this course of action, please, please would you put more police personnel on the walk so the speed limits are enforced? I think a hefty fine would be a good start. I have seen children as young as 4-5 years old riding battery powered scooters, cars and small bikes, some with training wheels. Careless operation only increases as the age increases to 7-9. To All City Council Members, I support prohibiting electric bicycles and other non -human -powered devices on the Boardwalk. I do this as a long term resident of the peninsula. The density of people on the Boardwalk has gone up and up. The addition of electric motor powered vehicles have added a dangerous additional ingredient. I have seen small children barely avoiding getting hit. worry about serious injuries to the public. I also worry that when someone is seriously hurt that the City will have liability for allowing a mixture of people and vehicles to occupy the same space that is unreasonable to do and that serious harm is readily foreseeable. I believe that the City's and the police department's failure to gather and keep records on injuries and near injuries will eventually be evidence of bad faith on the City's part. Please do the right thing for the good of the City, the residents of the City, and the visitors to the City. The members of Pier -to -Pier love the Boardwalk and are aware of the impacts that certain modes of transportation have on the safety of those who use the Boardwalk. Boardwalk users range from children who attend Newport Elementary to parents with toddlers and babies in strollers to fitness enthusiasts to our elderly residents and visitors. Pier -to -Pier would like to reiterate its position, which is "consistent and aggressive enforcement of existing laws (i.e., NO Surreys, and NO motorized vehicles)." Central Newport Beach Community Association appreciates the City of Newport Beach conducting this Study Session. (a) An "electric bicycle" is a bicycle equipped with fully operable pedals and an electric motor of less than 750 watts. (1) A "class 1 electric bicycle, "or "low -speed pedal -assisted electric bicycle, "is a bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour. (2) A "class 2 electric bicycle, "or `low -speed throttle -assisted electric bicycle, "is a bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour. (3) A "class 3 electric bicycle, "or "speed pedal -assisted electric bicycle, "is a bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour, and equipped with a speedometer.
