CITY COUNCIL AGENDA MAY ? 3 Ig94 ITEM NO.___14___ FMAY 2 3 199{._.APPiROVED^.._' FROM: PUBLIC WORKS DEPARTMENT SUBJECT: UNIT III UPPER NEWPORT BAY PROJECT (MAINTENANCE AND ENHANCEMENT OF UNIT I IN -BAY BASIN) BIOASSAY - COOPERATIVE AGREEMENT WITH COUNTY OF ORANGE/HARBOR, BEACHES AND PARKS (C -2987)b) RECOMMENDATION: Authorize the Mayor and City Clerk to execute the Cooperative Agreement with the County of Orange to share in the cost of Bioassays required for the Unit III Upper Newport Bay Project. DISCUSSION: In January the Upper Newport Bay Executive Committee requested the City to take on a lead role similar to the City's role on earlier In -Bay projects. That role was accepted and City Council approved an Engineering Services Agreement with John M. Tettemer and Associates to provide project management and design services necessary to prepare plans, specifications, contract documents, agreements; and to obtain permits, environmental clearance, and funding for the project. A copy of the most recent Project Status report to the Executive Committee is attached for information. Bioassay studies are required by State and Federal agencies to test dredge material for toxic contaminants and compatibility with the ocean disposal site. The U.S. Army Corps of Engineers and the Environmental Protection Agency have established a procedure for testing sediment samples for grain size distribution, chemical analysis and impact on living marine animals. In recent years, the tests have become more involved than the Bioassay required for Unit II Project in 1986. Currently Bioassays can require 6 to 9 months to perform the required testing and obtain required agency approvals. The Executive Committee requested the City and the County to coordinate work required for the Unit III maintenance project with the U.S. Army Corps of Engineers Upper Newport Bay Feasibility Study. The scope of the proposed Bioassay has been coordinated with the County and the Corps of Engineers to provide for the Corps of Engineers Feasibility Study, the Unit III Project, dredging anticipated near Dover Shores, and dredging anticipated by the County at the Newport Dunes. The cost of the proposed Bioassay is SUBJECT: UNIT III UPPER NEWPORT BAY BIOASSAY (MAINTENANCE AND ENHANCEMENT OF UNIT I IN -BAY BASIN) - COOPERATIVE AGREEMENT WITH COUNTY OF ORANGE/HARBOR, BEACHES AND PARKS (C-2987) May 23, 1994 Page 2 estimated to range from $125,000 to $150,000 depending on the testing program still to be approved by the EPA. Our consultant is working with EPA and anticipates approval of the testing program in June. The Corps of Engineers has agreed to credit the cost for the Bioassay towards the local share of the cost for the 50% Federal/50% Local cost sharing required for the Upper Newport Bay Feasibility Study. This agreement provides for $75,000 from the County of Orange for the Bioassay. In general, terms of the agreement provide as follows: 1. COUNTY Agrees: a. To pay City $75,000 within 30 days of receiving invoice from the City. b. To assist City in coordinating Bioassay with Corps of Engineers and resources agency. 2. CITY Agrees: a. To retain consultant and administer preparation of Bioassay. b. To provide copies of approved Bioassay to County and Corps of Engineers. C. To provide final accounting of Bioassay to the County. It is anticipated that The Irvine Company will also participate in funding a portion of the cost of the Bioassay. Budget amendments to provide these funds in the current fiscal year have been prepared and will be forwarded to the Finance Department when this Agreement is approved by the County Board of Supervisors and The Irvine Company share is approved by Irvine Company management.
