SUBJECT: Reciprocal Parking License Agreement between St. James Parish and the City
of Newport Beach
Parking Proposal
In conjunction with the proposed redevelopment of their church facilities located at 3209 Via Lido, St.
James Episcopal Church has requested that the City of Newport Beach consider the approval of a
reciprocal parking license agreement that would allow a shared parking arrangement between the City
and the church. Under the terms of the agreement, the church would be allowed to use 25 parking
spaces on Saturdays and 45 parking spaces on Sundays and City Hohdays, within the City Hall parking
areas shown on Exhibit "A" of the attached agreement. The hours of use for such parking will be 7:00
a.m. to 6:00 p.m. In exchange for such parking, the church agrees to allow the City to use 50 percent
• of the parking spaces located in the church parking lot, located at the southwesterly comer of 32nd
Street and Lafayette Avenue (old Bank of Newport site) between the hours of 7:00 a.m. to 6:00 p.m.
Monday through Friday. The agreement recognizes that during the two phases of construction which
the church anticipates, the number of parking spaces within the church parking lot will vary due to
construction activities; however, based on the proposed plans for the church redevelopment, the church
parking lot will include 80 parking spaces upon the completion of the project. Therefore, the number
of parking spaces available to the City is expected to be 40 spaces.
Although the agreement provides that the City and the church will maintain and repair their respective
parking areas, the agreement also includes a provision for the City to weekly sweep the church parking
area at the City's expense. The term of the agreement will run to December 31, 2014 and includes
provisions for it's automatic renewal on each consecutive twenty year anniversary.
At its meeting of March 13, 1995, the Finance Committee reviewed the proposed parking agreement
and recommended its approval to the City Council, with the following revisions:
1. The prior notification of termination by either party of the agreement should be
extended from one year to two years.
• 2. The provision that prohibits the City from requiring the church to provide suitable replacement
parking if the City terminates the agreement has been deleted. Instead, the church will have the
following options for replacement parking: (i) Church may secure from a third party the right
to use other off -site parking; (ii) Church may, upon a documented showing of reduced parking
needs, obtain City approval of a parking requirement which is less than the current 1:3 ratio. A
third alternative which was not discussed with the Finance Committee, but was subsequently

suggested by staff, is that the Church may have the right to use the City's 30th Street parking
lot, if it exists and is not committed to any other shared parking arrangement.
It is further suggested by staff, that should the church exercise the first option for replacement parking,
the approval of such parking should be subject to the off -site parking provisions set forth in Section
20.33.060 of the Municipal Code. Should the Church chose to exercise option two, the approval of
the demonstrated parking formula should also be subject to the approval of the Planning Commission.
Suggested Action
If desired, approve the proposed parking arrangement and authorize the Mayor to execute the
attached reciprocal parking license agreement between the City of Newport Beach and St. James
Parish.
