If approved, the ten sculptures will be on display for a two-year period, with installation commencing May 2020. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Approve the ten sculptures, three alternates and the proposed locations within Civic Center Park as recommended by the City Arts Commission for the temporary sculpture exhibit. FUNDING REQUIREMENTS: The City has received a State of California Department of Parks and Recreation Local Assistance Specified Grant Funding in the amount of $500,000 for the Civic Center Park Sculpture Exhibition, which will fully fund this project on a reimbursement basis. The Phase V project is budgeted at $141,436. The grant funds from the state will also cover Phase VI and concrete repair and rehabilitation needs at the site. DISCUSSION: The Sculpture Exhibition in Civic Center Park is an integral feature of the Newport Beach Civic Center. Civic Center Park, which turned nearly half a million square feet of undeveloped land into a new public park, was designed by renowned landscape architectural firm Peter Walker and Partners (PWP). PWP developed a master plan for art in the park and identified various locations in the park where sculpture may be exhibited. Sculpture Exhibition in Civic Center Park — Phase V March 10, 2020 Page 2 The City Arts Commission determined that a rotating exhibition was an optimal approach to bring sculpture to the City in a cost-efficient manner. Since August 2013, the Newport Beach City Council has had a rotational sculpture exhibit in Civic Center Park. The acquisition program that the City Arts Commission developed for the exhibition created a model in which pieces are loaned for a 2 -year period (or "phase"). Sculptors of works chosen for the exhibition are provided with a small honorarium to loan their work to the City. The City is responsible for installing the art, while sculptors are responsible for the maintenance and repair of their work. Admission is free and the exhibition continues to be enjoyed by residents and guests of all ages and sensibilities. In essence, the exhibition has become a "museum without walls" that offers the temporary display of public art in a unique, naturalistic setting. Moreover, the City is able to exhibit a well-balanced representation of public art, with artistic merit, durability, practicality and site responsiveness as criteria in the selection of work. The rotational nature of the exhibit ensures that residents and guests are exposed to a variety of work. Borrowing the pieces remains a cost-effective alternative to owning and maintaining permanent public art. The project team includes Mr. Richard Stein, President and CEO of Arts OC, Professor Joe S. Lewis, former Dean of the University of California, Irvine's Claire Trevor School of the Arts, Mr. Nicholas Thurkettle, Program Assistant for Arts OC, and Ms. Cindy Frommelt of Display Inc., a company that specializes in art installation. A call for entry was opened in January 2020 and 66 sculptors submitted works. Culture Net Listsery Affairs • New England Foundation for the • Artist Trust Arts • Americans for the Arts Public Art • California Arts Council Network • International Sculpture Center • SparkOC.com • College Art Association • ArtsOC Newsletter The call was also publicized through the Library and Cultural Arts email lists (over 20,000 emails) and websites, and through press releases to the local media. 11-2 Sculpture Exhibition in Civic Center Park — Phase V March 10, 2020 Page 3 Public Participation/Selection Process In order to provide the public with an opportunity to help with the selection process, the City Arts Commission conducted an online survey that invited the public to select individual works for inclusion in Phase V (Attachment C). The survey was sent to all library emails (20,000+), and a press release was run in the Daily Pilot/LA Times, Patch and the Newport Beach Independent. All 66 entries were included in the survey and participants were asked to choose their top three favorites which were all equally weighted. The results of the survey included 2,343 votes from 1,084 voters. In Phase IV, there were 1,601 votes. The February 13, 2020 regular City Arts Commission meeting allowed the public another opportunity to express their preferences on the works of art. In addition to the public at this meeting, the meeting included a curatorial selection panel who provided additional input into the process. This panel included: • The Arts Commission • David Michael Lee. Mr. Lee is Director and Curator of the Coastline Art Gallery at Coastline College in Newport Beach, where he also teaches art. • Tyler Stallings. Mr. Stallings is the director of Orange Coast College's Frank M. Doyle Arts Pavilion. The curatorial panel assessment included the following: • All top -scoring artworks in the online public survey were considered and discussed. However, four of the top 16 works were disqualified because of shipping costs and high honorarium requests. The City Arts Commission considered the piece, Hideaway Trellis, a potential climbing hazard. The piece is also covered with living vegetation, which poses potential maintenance issues. The sculpture, Little Swimmer, was submitted as a maquette and was thus disqualified. The City Arts Commission and curatorial panel ranked TipSee lower than Peace Arrow and selected the latter. The public closely ranked the remainder of the surveyed works and the City Arts Commission opted to rely on the assessment of the curatorial panel for Link of Humanity, Seated Diana, Marble Shooter, and Prime Mover. The piece Koi Pond was highly ranked by the public but may be difficult to place in the park and was selected as an alternate. The consulting team and City staff from the Public Works Department and the Library reviewed the proposed locations for each piece, based upon site sensitivities, scale, and impact of work. Staff also submitted the selections and locations for review by Risk Management and Public Works staff to identify potential public safety concerns. 11-4 Sculpture Exhibition in Civic Center Park — Phase V March 10, 2020 Page 5 Based on artwork value and preliminary budget provided by artists, the committee assigned honorarium amounts to each artwork. The consultants will present the selected works for City Council approval (Attachment A) "Recommended Works for Sculpture Exhibition in Civic Center Park Phase V"), with recommendations for siting the work (see Attachment B, "Proposed locations of Phase V sculptures"). ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
