This chapter provides that there shall be two official police tow agencies operating under a contractual agreement with the City. G&W Towing and Harbor Towing are currently the two official police tow agencies. Each contract is for a two year period, expiring on alternate years. The contract with G&W Towing Inc. expires on January 31, 1993. Notification of the open bid for official police tow contract was published in the Orange Coast Daily Pilot, and sent to tow truck companies currently licensed in the City. The bid period closed on December 16, 1992, with Jim's Towing and G&W Towing Inc. submitting bids to provide official police tow services. The Police Department was requested to inspect the equipment and facilities and report on the qualifications of each applicant. Copies of the submittal from G&W Towing Inc., Jim's Towing Service, and the Police Department's report are attached. Section 5.15.070 provides that after consideration of an applicant's ability to satisfy Municipal Code requirements for standards for tow truck equipment and standard rules of operation (Sections 5.15.100 and 5.15.110), the City Council shall take into account the following considerations: (A) Whether the applicant is qualified on the basis of moral character, experience in the towing business, and financial responsibility; (B) The level and quality of service which would be made available to the public: such as, accessiblilty and adequacy of the storage facilities, whether there is an attendant on duty as opposed to being on call to release vehicles on a 24-hour basis, and availability of extra pieces of equipment over the minimum required; (C) Reasonableness of fees to be charged for service and willingness to release vehicle without charge if impounded or stored in the course of carrying out an official police investigation, upon direction of the Chief of Police; (D) Physical condition of equipment. Newport Beach Municipal Code Section 5.13.150 requires a tow truck driver obtain a permit from the City to operate a tow truck in the City. JIM'S TOWING Jim's Towing (Jim's) has been licensed by the City as a tow truck operator, for non -police services, since 1987. Jim's has listed nine (9) tow trucks to be operated as official police tow trucks. Eight of the nine tow trucks listed by Jim's have been inspected by the Police Department and found to meet Municipal Code requirements. Jim's has represented current outdoor storage facilities at 935 West 18th Street (Costa Mesa) capable of storing approximately 50 vehicles. Jim's has also indicated the ability to expand outdoor storage by an additional 65 to 75 vehicles at two currently unimproved lots in the 1700 block of Monrovia Avenue (Costa Mesa). Although these two lots do not currently meet Municipal Code requirements, the applicant has indicated the ability to bring these lots into compliance within one month if awarded the contract. Inside storage on 18th Street has the capacity for five (5) vehicles. Jim's does not employ bilingual dispatchers. Facilities at 18th Street are reportedly handicap accessible. Jim's Towing has not provided police towing services for any city, but does provide service to the California Highway Patrol. Of the eleven (11) drivers listed by the applicant, one (1) has satisfied the permit requirements of Section 5.13.150. G&W TOWING INC. G&W Towing Inc. (G&W) has been providing tow services in the City continually since 1973. The Police Department has inspected the sixteen (16) vehicles listed by G&W, and found them to comply with Municipal Code requirements. G&W has paved outside storage facilities at 965 West 18th Street (Costa Mesa) capable of storing over 300 vehicles. Inside storage at their facility can accommodate 30 vehicles. G&W employees bilingual dispatchers. Their facilities are handicap accessible. G&W Towing Inc. has been providing police towing services for this city since 1973, and police tow services for the City of Costa Mesa since 1981. G&W also provides tow truck services to the California Highway Patrol, Orange County Marshals and the Department of Motor Vehicles. G&W Towing Inc. has an excellent record in providing official police tow truck services in this city. All twelve (12) of the tow truck drivers employed by G&W are permitted by this city. p.2 Discussion The Police Department did not provide, nor did this office's investigation include, a report on the moral character of the applicants. G&W has fourteen (14) years more experience in providing tow truck services in the City of Newport Beach than Jim's. Jim's has no police tow truck experience, while G&W has provided official police tow truck services for nineteen (19) years in this city and eleven (11) years in Costa Mesa. A statement from each company, addressing their financial responsibility, is attached. Both applicants meet Municipal Code standards for tow truck equipment and storage facilities. G&W Towing Inc. operates seven (7) more tow trucks than does Jim's Towing, provides at least one hundred and seventy-five (175) more outside storage spaces and at least twenty-five (25) more inside storage spaces than does Jim's. Fees charged by official police tow truck operators in this City are fixed by Resolution of the City Council. Both G&W and Jim's have represented a desire to cooperate with the Police Department in impound fees on official police investigations. At the request of Council, a review of civil court actions brought against tow truck operators has been included in the investigation of these two applicants. Harbor Municipal Court Civil Index records reflect that during 1991 Jim's Towing was listed as a defendant in two (2) civil actions while G&W Towing Inc. was listed in four (4) civil actions. Jim's Towing represented that they provided approximately twenty thousand (20,000) tow services (non -police related) while G&W provided approximately twenty five thousand (25,000) tow services (police and non -police) in 1991. G&W represented that they prevailed in three of the four suits filed against the company. Recommendation Based on the company's experience in providing both police and non - police tow truck services in the City of Newport Beach, the level and quality of service, availability of extra pieces of equipment over the minimum required and the superior storage facilities of G&W Towing Inc., the Police Department and the Revenue Division respectfully recommend G&W Towing Inc. for the official police tow truck contract. (a general partnership) in which FBC Industries owns a 75% interest. All significant intercompany accounts and transactions have been eliminated. (b) Inventories --Beer and wine inventories are shown at cost using the last -in, first -out (LIFO) method. Management believes that the use of the LIFO method results in a better matching of costs and revenues. If the first -in, first -out (FIFO) method had been used, inventories would have been $541,458 and $195,470 higher than the inventories reported at December 31, 1991 and 1990, respectively. Inventories of cooperage and others are determined using the specific cost method. WHEREAS, Section 5.13.140 of the Newport Beach Municipal Code provides that each holder of a Certificate of Public Convenience and Necessity for the operation of a two truck service shall file with the City a proposed schedule of rates to be charged by said Certificate holder, said rates to be established by the City Council upon holding a public hearing; and WHEREAS, on June 11, 1990, the City Council of the City of Newport Beach adopted Resolution No. 90-52 approving the tow truck rate schedules for tow services within the City of Newport Beach provided by G & W Towing and Harbor Towing; and WHEREAS, G & W Towing and Harbor Towing has submitted to the City Council its respective proposed schedule of rates to be charged for tow services within the City of Newport Beach; and WHEREAS, Section 5.15.080 of the Newport Beach Municipal Code provides that the City and the Official Police Tow Service may review and revise fee schedules, by mutual agreement, at any time, upon a finding that a rate increase is justified and is in the public interest; and WHEREAS, the Official Police Towing Service Certificate holder, G & W towing, has submitted a request to increase the towing charges and storage rates based upon the continuing rise in the cost of doing business; and WHEREAS, G & W Towing and Harbor Towing proposes a uniform fee schedule for both the Official Police Towing rate and the schedule for tow services within the City of Newport Beach, independent from the Official Police Tow; and WHEREAS, the City Council held a hearing on May 28, 1991 to consider the requests.
