CSF NEWFO t' ROACH Municipal Code Chapter 5.15 "Official Police Tow Truck Service", which was amended in 1979, provides for the designation of two separate companies to perform the necessary towing services. Additionally, the Code, as amended, provides that the initial service agreements will be for terms of two and three years, respectively, and that the two companies selected will determine by lot which of them receives the longer term initial agree- ment. Following the expiration of the initial agreements, each subsequent agreement is to be for a period of two - years, with a twelve month overlap. In January 1980 the City entered into Official Police Tow Service agreements with the current operators, Harbor Towing and G & W Towing. Pursuant to the Municipal Code, the two companies had determined by lot that G & W would receive the three-year initial contract and Harbor the two-year contract. As such, the Harbor agreement expired and was renewed for a two-year period in January 1982. The G & W agreement (Att. 1) will expire on January 28, 1983. In accordance with M.C. Section 5.15.030, the City Clerk advertised for bids to operate the second official Police Tow service. G & W Towing was the only company which submitted a bid. The hearing, on a new two-year agreement for G & W Towing, was scheduled for January 24, 1983. Bid Analysis Attachment 2 is the bid submitted by G & W Towing. The Municipal Code provides that all Official Police Tow impound yards are to be located within a two. -mile radius of the Newport Beach Police facility. The G & W main yard is located at 132 Industrial Way in Costa Mesa, well within the ten -mile required radius. G & W is not proposing any increase in currently approved rates and charges. TO: MAYOR AND CITY COUNCIL The Police Department, in a report and attachments dated January 10, 1983, evaluates the facilities, equipment and general operations of G & W Towing (Attachment 3). The Department finds G & W Towing to be an acceptable Police Tow agency and supports renewal of the subject agreement. Recommendation It is staff's position that G & W Towing has performed satisfactorily as an Official Police Tow agency and should be granted a new two-year contract. It is recommended that the City Council authorize execution of a new agree- ment with G & W. ROBERT L. W I T N E S S E T H: WHEREAS, the City Council of the City of Newport Beach has selected Operator as one of the "Official Police Tow Truck Services"; and WHEREAS, Section 5.15.080 of the Newport Beach Municipal Code requires that an agreement between City and Operator which contains the eligibility requirements, operating regulations and fee schedules for the operation of "Official Police Tow Truck Services," NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: 1. The parties hereto mutually agree that the opera- tion of Operator's "Official Police Tow Truck Service" will be in conformity with the eligibility requirements and operating regulations contained in Chapter 5.15 of the Newport Beach Municipal Code, which is attached hereto marked as Exhibit "A" and which by this reference is incorporated herein as if fully set forth. 2. The parties hereto further mutually agree that the fee schedule for the operation of the "Official Police Tow Truck Services" within the City of Newport Beach shall be as set forth in that resolution adopted by the City Council of the City of Newport Beach on January 7, 1980, which is attached hereto marked as Exhibit "B" and which by this reference is 3 incorporated herein as if fully set forth. One of these is the acquisition of our main office and storage facility at 132 Industrial Way in Costa Mesa with a capacity of approximately 100 cars. In addition we have acquired a auxiliary storage facility which is located at 1666 Monrovia in Costa Mesa. The location of this new auxiliary storage has proved to be quite convenient due to the fact that it is within 4 blocks of our main office and has a capacity of over 200 cars. To improve our response times and efficiency we have replaced our 2 way radio system with Motorola's finest state of the art communications system. Also we have continued to maintain the quality of our fleet of service trucks with the replacement of 6 trucks with new units. The premises were found to be neat, clean and fenced in by a six foot block wall. An enclosed storage facility for three (3) vehicles is on the premises.
