HARBOR QUALITY COMMITTEE MINUTES
March 10, 1994

MEMBERS PRESENT: Jean Watt, Evelyn Hart,Tony Melum, Jack Skinner,
Rosemary Luxton, Oscar Frenzel, Miriam Mayell,
Ralph Furra, Susan Leifer, Nancy Skinner, Wes
Armand.
GUESTS PRESENT: Monica Mazur., Larry Paul, Holly Veale, Dick
Olson, Mike Boudreaux.

CALL TO ORDER: The meeting was called to order by Chairman Jean
Watt, at 3:30 P.M.
APPROVAL OF The minutes of February 10, 1994, were approved
MINUTES: as amended. Page three, paragraph four, first
sentence. Jack Skinner motion to delete first
sentence. NBCC did not support running_S.D.
Creek water through the San Joaquin Freshwater
Marsh.. Motion passed.
AGENDA:
1. Discussion - Revision of Municipal Code 5.18. Staff
Melum reviewed the status on the proposal and pertinent aspects of
the penalty section, particularly the section regarding denial of
a permit for violations of the charter ordinance. Mejum discussed
information received from Avalon and the success that city has
experienced with court'challenges to their ordinance. The city has
defended and sustained its regulation at the Superior Court level.
Avalon may deny access to the harbor for up to one year for
discharge violations.
Jack Skinner requested staff to provide more information regarding. -
the appeal process. Could the defendant continue to operate
charters during this period, what would be the length of the appeal
period, etc. Staff to report next meeting.
Mayell requested information regarding the scope of the dye tab
program currently in place throughout the harbor. Staff to send her
fact sheet. Mayell also requested information regarding the Harbor
Department policy regarding rafting vessels in the Turning Basin
(east Lido Island). Olson described the application process, permit
issued, and Harbor Patrol intention to check for MSD (SB 1201)
compliance with dye tabs if necessary.
Nancy Skinner asked in the event a boat charter violation occurred,
permit denied, and defendant proceeds to appeal the case to the
City Manager, will the appeal meeting be open to -interested
citizens (public meeting)? Staff will report next meeting.
Evelyn Hart commented on Section 5.18.005.D relating to traffic
congestion, parking shortages, excessive noise, and the discharge
Of waste that could result from unregulated charter activity and
stated that eventually the commercial activity in the harbor could
begin to denude the natural resources and there must be an
acknowledgement that there is a limit to the commercial activity
after which harbor quality suffers.
Jack Skinner asked if there would be a corressponding revision in
Chapter 17.41 MC which regulates the commercial harbor activity
permittees (Hornblower, Pavilion, Fun Zone, etc.) strengthening the
penalty sections where there are water quality violations. Malum
discussed the permit which regulate these operators and the serious
consequences that could follow any water quality violation.
2. Review activities of Newport Bay Coordinating Council. Nancy
Skinner.
Skinner reported on the .March 10, 1994 meeting at the Newport
Dunes. The main agenda item was the report by the Education
Committee. This committAe has meet with three teaching specialist
from the Municipal Water` District, Orange County, and will attempt
to take a broad cohesive approach incorporating assistance from
other programs in the County (Kids in the Creek, Upper Bay
Naturalist programs, etc.) and possibly broadening the scope of the
targeted area by making this a Santa Ana Watershed program.
A 28 minute film is in the works and will be shown on Public cable
proorams .
3. Committee Report, Baywatchers. Rosemary Luxton/Bud Frenzel
Display and handouts for Earth Day, April 17th, at Shellmaker
Island, Upper Newport Bay. Volunteers were Miriam Mayell, Wes
Armband, Bud Frenzel, Sue leifer, and Rosemary Luxton. Rosemary will
coordinate application for the booth with Nancy Bruland, EMA
Harbor, Beaches and parks Dept.
4. Debris boom, Santa Ana Delhi Channel. Michael Boudreaux
Boudreaux reviewed the proposal for the debris boom delivered to
orange County Public works about 3 months ago and stated there has
beep very little response. Sea Tech's proposal includes
installation and monthly maintenance. Boudreaux asked what needs to
be Clone to move it along? Larry Paul, EMA Engineering said no other
meetings scheduled with Sea Tech. May need to locate alternate
source(s) for boom or let BHA work the it through to completion.
Need a creative way to approach it.
Watt asked if the committee can provide any help? Nancy Skinner
will contact Mike Ruane, EMA Director and invite him to see the
debris in the Santa Ana Delhi Channel. The issue of the boom can be
brought up and discussed.

5. Lcofoam. Nancy and Jack Skinner demonstration of biodegradable
package filler.
This filler is made using a cornstarch base. Unlike styrofoam
filler, Ecofoam dissolves in water and does not produce litter. The
committee discussed how to acknowledge the local companies now
using this product.
NEXT MEETING: Thursday, April 14, 1994, at 3:30 PM, Fire
Department Conference Room.
