(9) Roll Call The meeting was called to order at 7:05 P.M. by Chairperson Barbara Shelton at the Newport Beach Police Department auditorium. Excused absences: Councilmember Hart, Councilmember Watt, Mark Kerslake. (1 Approval of Minutes March minutes were approved as submitted. ® Brown Act Dave Niederhaus gave a dissertation on the amendments to the Brown Act which became effective April 1, 1994. Mr. Niederhaus stated that the purpose of the Brown Act is to maximize public participation in, and knowledge of, decisions made by local government. Mr. Niederhaus then proceeded to explain in detail each of the new amendments to the Act. Mr. Niederhaus also stressed the importance of the officers of E.Q.A.C. be well versed in the procedures that need to be followed in order to conform to the Brown Act. 6 Sub -committee Reports a) C.O.N.C.E.R.T. Terrance Philips reported that final preparations were being made for the April 24th Earth Day Poster contest. Mr. Philips also stated that volunteers are needed to contact environmentally conscious businesses and organizations to seek their participation. Mr. Phillips also noted that world class surfer Richie Collins had donated a surf board which would be awarded to one of the contest participants. Mr. Phillips went on to say that he had received gift certificates from Planet Hollywood and Edwards Cinemas. Mr. Niederhaus discussed the possible negative ramifications of soliciting funding and donations for a City committee. Mr. Niederhaus stated he would research the matter further and report back to Chairperson Barbara Shelton. Committee members expressed their support and gratitude to Mr. Phillips for his tireless efforts in coordinating the upcoming event. b) Earth Day Chairperson Barbara Shelton reported that volunteers were needed to staff the E.Q.A.C, booth at the fifth annual celebration of Earth Day at Upper Newport Bay on April 17th, 0 Recycling Mr. Niederhaus reported that the City residential recycling program at the C.R.T. facility was continuing to operate above the 25% quota. The other City recycling, asphalt, concrete, and green waste programs were also operating well. Mr. Niederhaus also noted that new contracts had been awarded to Ware Disposal for the recycling of concrete, asphalt, and brown waste, and to Rainbow Disposal for the recycling of green waste. d) E.I.R. Chairperson Barbara Shelton reported that John Douglas, City Planning Department, conducted a seminar on Environmental Impact Reports and their importance. The seminar was attended by Chairperson Barbara Shelton, Nancy Gardner, and Mark Kerslake. Nancy Gardner stated that the E.I.R. for the proposed expansion of the Balboa Bay Club was now up for review and committee input was welcome. A resolution was made and passed which would encourage businesses to report to the City their environmentally positive actions when applying for permits and licensees. e) Polystyrene Abatement Ed Hepner reported that he had spoken to the Vice President of Starbucks coffee houses in Seattle to see what types of environmentally positive actions they were taking to reduce waste. Mr. Hepner stated that Starbucks was giving discounts to customers who brought in their own mugs for their coffee. Starbucks also rewards their customers who use their old coffee bags to get refills. Mr. Hepner felt Starbucks was a good role model for other businesses to emulate and should be recognized for their efforts. Committee members agreed, and a motion was approved, to award them with a letter of environmental recognition. Mr. Niederhaus reported that he had received feedback from Glen Everroad, City Revenue Manager, regarding Mr. Hepners request that businesses tell the City what positive things they were doing environmentally. Some of Mr. Everroads questions were which businesses to target, where would the licenses respond to, and who would answer their questions. Mr. Hepner stated that he would rewrite his proposed letter to address the concerns of Mr. Everroad. f) Beautification Awards Mr. Kilmer reported that the three recent recipients of Beautification Awards would be recognized at the April 11th City Council meeting. g) Environmental Achievement Award Due to the absence of Gregg Schwenk, no report was given. h) Composting Marge Pantzar displayed the composting exhibit she would be using at Earth Day April 17th, the General Services Open House April 23rd, and the Poster Contest April 24th. © Old Business AOMD Gas Nozzle Reffulations Officer John Ludvigson reported that a representative from A.Q.M.D. would be a guest speaker at the May 2nd E.Q.A.C. meeting. Haz-Mat Awaren /Buildinff Permits Officer John Ludvigson stated that the Building Department had a hazardous material checkoff list for contractors operating within the City and that it was the Building Inspectors job to follow up. Building Material Update Mike Kilbride noted that there were no such checklists for contractors applying for encroachment permits within the City. Officer Ludvigson stated he would investigate. OO New Business Fire Marshall Lockard gave a presentation on the difference between hazardous material and hazardous waste as well as the proper disposal methods of the latter. Mr. Lockard also spoke about the disclosure requirements within the City for companies which have hazardous materials on site. Captain DeTevis noted the availability of the County of Orange Household Hazardous Materials Collection Centers which offer residents a safe and proper method for the disposal of household hazardous materials. Officer John Ludvigson noted past injuries to sanitation workers which were caused by fumes, spills, and chemical explosions due to improper disposal methods. Ray Zarlter spoke about the importance of monitoring building and construction contractors who typically have hazardous material and waste on their job sites. There being no further business a motion was made and approved to hold the next E.Q.A.C. meeting on May 2nd, 1994 at the Newport Beach Police Auditorium at 7:00 P.M.
