SUBJECT: ENCROACHMENT AGREEMENT FOR CONSTRUCTION OF A PRIVATE DRAIN WITHIN
THE AVOCADO STREET RIGHT-OF-WAY
OWNER: Bank of Newport
RECOMMENDATIONS:
1. Approve an encroachment agreement for private storm drain
improvement in the public right-of-way with the Bank of
Newport, and authorize the Mayor and the City Clerk to
execute the agreement.
2. Authorize and direct the City Clerk to have the agreement
recorded with the Orange County Recorder.
DISCUSSION:
The Bank of Newport has proposed to construct a private storm drain
line in Avocado Avenue in order to connect into an existing public storm
drain line. The proposed storm drain will eliminate the continual flow of
water along the westerly side of Avocado Avenue caused by the Bank of Newport
pumping water from its subterranean garage.
The agreement will allow construction of the private storm drain
improvements as approved by the Public Works Department, and requires that
the property owner be responsible for maintenance and restoration of those
improvements.
