MILLER FROM A DENIAL BY THE PUBLIC WORKS DEPART- MENT OF AN APPLICATION TO CONSTRUCT BRICK SIDEWALK AND DRIVEWAY APPROACH ON ISLAND AVENUE ADJACENT TO 501 WEST EDGEWATER, BALBOA RECOMMENDATIONS: If desired: a. Uphold the denial of the application; or b. Approve the application subject to the execution of an encroachment agreement for non-standard improvements. DISCUSSION: Attached is a letter from Leonard W. Miller appealing the denial by the Public Works Department of an application to construct brick sidewalk and driveway on Island Avenue adjacent to 501 West Edgewater, Balboa. The loca- tion is shown on the attached sketch. City Council policies permit brick or stamped concrete to be placed in parkways. The staff tries to restrict brick or stamped concrete to those areas located between sidewalk and curb that are not used for pedestrian walk- ways. Brick or stamped concrete sidewalks may be constructed in commercial areas subject to the execution of encroachment agreements for non-standard improvements which are recorded with the County Recorder and run with the land. They guarantee the maintenance of the improvements by the property owner and hold the City harmless should an accident occur. Agreements for non-standard improvements have been limited to commercial areas where the property owners have both financial ability and easy access to maintenance capabilities. Agreements for non-standard improvements are not recommended for use in resi- dential areas. The rationale for preferring the use of standard concrete sidewalk is that it is considered to be safer for pedestrians and it is less costly for the City to repair should repair become necessary. Parkways on Island Avenue are 7.5 feet from property line to back of curb. Existing sidewalks are 5.5 feet wide. The applicant proposes to con- struct brick pavement from property line to back of curb, laying the bricks in a fan -shaped pattern. r Benjamin B. Nolan Public Works Director KLP:jd Att. Gentlemen: COON IL AGENDA Leonard W. Miller 18121 Irvine Blvd, Tustin, Ca. 92680 The Public Works Department has denied the use of brick material on the driveway from the driveway and sidewalk from our house to the curb. The brick we wish you to consider is heavily fired and is considered more "non -slip" than a concrete sidewalk. A sample has been given to the City Clerks Office for your consideration. The brick we intend to install will be as flat as.a sidewalk. Not with deep grout lines or with a cobblestone effect. We wish to use an approach sim- ilar to the installation in Corporate Plaza in Newport Beach. A picture of the sidewalk and driveway is attached. In addition to the above, we intend to fix the curb and gutter in the street in front of our property, at our own expense, which currently is in dangerous disrepair, as can be noted by attached photograph. Our installation will upgrade the area with both safer conditions and also a much more asthetic affect. A walk from the Bay Island bridge to the ferry along Edgewater Drive illustrates the horrible condition of surround- ing neighborhhod sidewalks. We believe we are offering an extremely safe condition and do not wish to jeopardize our assets or reputation with a dangerous condition. Obviously, the city does not wish to consider a dangerous proposal either. Our project is not a precedent in Newport Beach. Many areas have smooth, flat, non -slip sidewalks and driveways such as in Corporate Plaza, Lido Village, Lido Island, and also sidewalks on the peninsula closer to the jetty, We thank you for your consideration of this matter. Bay Island entrance is across street, Sidewalks in area are in atrocious condition. Especially Edgewater Drive, between Bay Island and ferry. Curb and street in front of 501 West Edgewater is bad, We will repair at our expense. Brick sidewalks and roadways are in Lido Villagee', also ort Beach, Corporate Plaza, and other various Newport locations.
