BALBOA PIER
BUILDING EXPANSION AND REFUSE DISPOSAL'S
ACTION: Approve amendment to Concession Agreement to
provide for building expansion and refuse
disposal; and
Approve request to expand existing building.
EXPANSION: Ruby's Restaurant is requesting to expand
the existing building to provide additional storage
space and a walk-in refrigerator as depicted on the
attached drawings.
Also, the amount of refuse generated by the restaurant
has exceeded what was originally anticipated and cannot
be handled by conventional bins.or containers. As shown
on the attached photographs provided by Ruby's, bags of
refuse have accumulated on the pier.
The existing agreement with the operator of Ruby's provides
only for the use of the existing building and obligates the
City to provide refuse collection services. A lease amend-
ment is required to allow Ruby's to expand and to obligate
the Concessionaire to provide an enclosure to store refuse.
COMMENTS: The proposed expansion as depicted on the
attached drawings appears to maintain the integrity
of the design of the building and removes little space
usable by the public on the pier. The expansion proposal
has been given a preliminary review by the Public Works

Department and no insurmountable problems appear to
exist. All work will be subject to the granting of
a building permit.
Storage of large volumes of refuse on the pier presents
a problem to the Refuse Division which cannot operate
large vehicles on the pier to pick up large commercial
type bins. Additional can -type containers would be
expensive and unsightly. The Concessionaire on the
Newport Pier provides a lockable enclosure which would
also be appropriate on the Balboa Pier. The Refuse
Division would be able to service the enclosure with
the small pick-up sized packer.
An appropriate amendment to the Concession Agreement
is attached for review and approval by the City Council.
