F-12 SUBJECT: Application of Brion Jeannette to construct a 3 -foot -high masonry wall encroaching 4 -feet into public right-of-way of Beacon Street adjacent to 400 Santa Ana Avenue. RECOMMENDATIONS: If desired, approve the application subject to: 1. Execution of an Agreement for Non -Standard Improvements; and, 2. An Encroachment Permit from the Public Works Department. DISCUSSION: Attached is a letter from Brion Jeannette, 400 Santa Ana Avenue (at the corner of Beacon Street), requesting approval to construct a 3 -foot -high masonry wall which will encroach 4 feet into the public right-of-way of Beacon Street. The location is shown on the attached sketch. The wall location would not interfere with sidewalk construction on Beacon Street should sidewalks be installed in the future. Council Policy L-6, "Private Encroachments in Public Rights -Of -Way", provides that the prior approval of the City Council is required for any structural encroachment that encroaches more than 1 foot into the public right-of-way, or is more than 3 feet in height. Policy L-6 also permits structural encroachments not exceeding 3 -feet in height measured from the top of the curb in areas of Santa Ana Avenue that are more than 8 feet behind the face of the curb, subject to execution of an Agreement for Non -Standard Improvements and an Encroachment Permit from the Public Works Department. At 400 Santa Avenue, the parkway on Santa Ana Avenue is 22 feet in width. (For the Council's information, Mr. Jeannette's project also includes encroachments on the Santa Ana Avenue frontage which are allowable under the policy, and for which a staff issued encroachment permit is authorized). Attn: City Council We are requesting the ability to build low planter walls on the Beacon Street side of our property. The walls will not exceed 18" from natural grade at a distance of 810" minimum from the curb. The height measured from the curb is 216" maximum. The low planter wall assists in retaining planter areas that have exotic plant materials from the lawn adjacent to it.
