F-19 TO: CITY COUNCIL APPROVED FROM: Public Works Department SUBJECT: APPLICATION OF DONALD ZELLNER TO CONSTRUCT A DRIVEWAY APPROACH AND A PEDESTRIAN WALKWAY AT GRADE IN OCEAN BOULEVARD; TO PERMIT A BUILDING, RETAINING WALL AND PATIO TO ENCROACH INTO A SEWER EASEMENT ON PRIVATE PROPERTY; AND TO CONSTRUCT A RETAINING WALL AND STAIRWAY IN AN UNOCCUPIED STORM DRAIN EASEMENT CENTERED ON THE PROPERTY LINE BETWEEN LOTS 12 AND 13, TRACT 1257 (EP -87-258). RECOMMENDATION: If desired, approve the application subject to: a. Execution of an agreement for non-standard improvements, and b. An encroachment permit from the Public Works Department, and c. Building permits from the Building Department. DISCUSSION: The applicant desires to construct a house at 3601 Ocean Boulevard next to Inspiration Point. The location is on Lot 13, Tract 1257. The location of the property and the details of the proposed encroachments are shown on the attached sketches. The driveway approach and pedestrian walkway will be at grade and will connect the house with the existing asphalt concrete driveway in Ocean Boulevard which was constructed as part of the improvements for Resubdivision No. 227. The sewer easement is on private property and is parallel to Ocean Boulevard. The existing sewer will not be underneath the proposed building, retaining wall or patio slab. The agreement for non-standard improvements will contain language to protect the City's ability to maintain the sewer. The storm drain easement along the common boundary line of Lots 12 and 13 of Tract 1257 was dedicated on the map of Tract 1257, but is not used for storm drain purposes because the existing storm drain is located slightly west of the easement on property owned by the State of California and administered by the City as part of the Corona del Mar State and City Beach Park. The City has no plan to relocate the storm drain. The retaining walls in the storm drain easement will be up to twelve feet in height, and the retaining wall in the sewer easement will be up to eight feet in height, but all will be below ground level. There should be no inter- ference with the view from above. The Parks, Beaches and Recreation Department has no objection to the proposed encroachment into the sewer easement. The Utilities Department has no objection to the proposed encroachment into the sewer easement. A larger exhibit will be on display in the Coun it Chambers. Benjamin B. Nolan Ronald A.
