SUBJECT: QUITCLAIM DEED FOR A SEWER EASEMENT IN RESUBDIVISION NO. 451
LOCATION: NORTHERLY CORNER OF SUPERIOR AVENUE AND HOAG DRIVE
SUBDIVIDER: MARINERS SAVINGS AND LOAN ASSOCIATION
RECOMMENDATIONS:
1. Adopt a resolution approving a quitclaim deed for a sewer
easement and authorizing the Mayor and the City Clerk to
execute the quitclaim deed.
2. Authorize the City Clerk to have the executed quitclaim
deed recorded by the Orange County Recorder.
DISCUSSION:
Resubdivision No. 408 was approved by the Planning Commission on
September 20, 1973. It created three parcels of land for development. A con-
dition of approval required that a ten -foot wide sewer easement be dedicated
across Parcel 1 in order to provide public sewer service to Parcel 3. An
appropriate Grant of Easement was executed and recorded (O.R.11081/1643).
On May 2, 1974, the Planning Commission considered and approved
Resubdivision No. 451. It combined Parcels 1 and 3 of Resubdivision N o. 408
into one new parcel of land for development. This action had the effect of
eliminating the need for the sewer easement recently acquired. In addition,
the building proposed for construction on this property will be located over
the sewer easement.
In order to preclude this physical conflict as well as to remove
an unnecessary encumbrance on the record title for this property, execution
and recordation of a Quitclaim Deed for the sewer easement (O.R.11081/1643)
is recommended. Public sewer service to the area can be adequately provided
without this particular sewer easement. Approval of the recommended actions
will satisfactorily resolve and conclude this matter.
