SUBJECT: APPLICATON OF GARY WILDER TO CONSTRUCT A 1.5 FOOT HIGH FENCE WITH 3
FOOT HIGH PILASTERS; AND NON-STANDARD PAVEMENT AT GRADE, ALL
ENCROACHING 7 FEET 7 INCHES INTO THE PUBLIC RIGHT-OF-WAY AT 1702 SOUTH
BAYFRONT, BALBOA ISLAND (EP -88-298)
RECOMMENDATIONS:

2. Approve the application subject to:
a. Execution of an Agreement for Non -Standard Improvements.
b. An Encroachment Permit from the Public Works Department.
c. A Building Permit from the Building Department.
DISCUSSION:
Application has been made to construct a 1.5 foot high fence with 3
foot high pilasters; and non-standard pavement at grade, all encroaching 7 feet
7 inches into the public right-of-way at 1702 South Bayfront, Balboa Island.
The location is shown on the attached sketch.
Council Policy L-6, "Private Encroachments in the Public
Rights -of -Way," requires the prior approval of the City Council for any private
encroachment that encroaches more than one foot into the public right-of-way, or
is over three feet in height.
Recommendation for denial is based on the wording of Policy L-6, which
provides that public rights-of-way are to be reserved for public use or open
space, and that the rights of the public, both present and future, are not to be
diminished by the installation of private improvements in public rights-of-way.
