SUBJECT: NON-STANDARD ENCROACHMENT AGREEMENT..
LOCATION: 117 Bayside Place
Part of Block "D" of the Corona Del Mar Subdivision
RECOMMENDATIONS:
1. Approve an Encroachment Agreement for Non -Standard
Improvements over a public utilities and sewer easement within the
limits of a private road; and authorize the Mayor and the City Clerk
to execute the Agreement.
2. Authorize and direct the City Clerk to have the Agreement recorded
with the Orange County Recorder.
DISCUSSION:
The property owners propose to modify an existing retaining wall and
install a hot -tub with decking, stairs and appurtenant wooden
improvements over an existing City sewer. As a condition of approval
the property owner will replace the aging City sewer pipe beneath the
proposed improvements.
The Agreement stipulates that in addition to the sewer replacement,
the property owners and their successors in interest shall be responsible
for any future restoration of the encroaching improvements should
City maintenance, repair or replacement activities require their
demolition; either partially or wholly.
