SUBJECT: AGREEMENT FOR MEDIAN MAINTENANCE ON LA VIDA - TRACT NO. 12271
LOCATION: La Vida between University Drive and La Salud in the Newport
North Development
DEVELOPER; The Irvine Company, Newport Beach
RECOMMENDATIONS:
1. Approve an Encroachment Agreement and Declaration of Covenants
between landowners for street median improvements along La Vida
adjacent to Tract No. 12271; and authorize the Mayor and the City
Clerk to execute the agreement.
2. Authorize and direct the City Clerk to have the agreement recorded
with the Orange County Recorder.
DISCU$SION:
A condition of approval for Tract No. 12271 was that the median
landscape improvements in La Vida would be maintained by the Irvine Company or
their successors in interest unless otherwise approved by the City. The
Developer has completed the median landscape improvements with the irrigation
system and the timer control system integrated in with the Tract No. 12271
perimeter landscape improvements.
The landscape median agreement allows the Irvine Company to construct,
reconstruct and maintain the median landscape improvements within the La Vida
right-of-way, as approved by the Parks, Beaches and Recreation and Public Works
Departments, and require that the Irvine Company and their successors in
interest be responsible for maintenance and restoration of these improvements.
