SUBJECT: APPLICATION OF D. KROTEE AND J. LOMBARDO TO CONSTRUCT 4.5 FOOT HIGH
FENCE, GATE, BOLLARDS, THEME MAILBOX AND NON-STANDARD PAVEMENT IN THE
PUBLIC RIGHT-OF-WAY ADJACENT TO 2916 CLAY STREET (EP -88-285).
RECOMMENDATIONS:
1. Deny the application; or
2. Approve the application subject to:
a. Execution of an agreement for non-standard improvements.
b. An Encroachment Permit from the Public Works Department.
c. A Building Permit from the Building Department.
DISCUSSION:
Application has been made to construct a 4.5 foot high fence, gate,
bollards, theme mail box and non-standard pavement in the public right-of-way
adjacent to 2916 Clay Street. The location is shown on the attached sketch.
The fence, gate and bollards will encroach about 8 feet into the 12 foot wide
parkway. The mailbox and non-standard pavement will encroach to the curb. The
location is shown on the attached sketch.
Council Policy L-6, "Private Encroachments in the Public
Rights -of -Way," requires the prior approval of the City Council for any private
encroachment that encroaches more than gyne foot into the public right-of-way, or
is over three feet in height.
Recommendation for denial is based on the wording of Policy L-6, which
provides that public rights-of-way are to be reserved for public use or open
space, and that the rights of the public, both present and future, are not to be
diminished by the installation of private improvements in public rights-of-way.
The proposed encroachments are substantial and will create the feeling that the
area behind the fence is private property rather than public right-of-way.
