SUBJECT: APPLICATION OF ROD EMERY TO CONSTRUCT WALKWAY AND STAIRS ENCROACHING
FOUR (4) FEET INTO OCEAN BOULEVARD ADJACENT TO 2741 OCEAN BOULEVARD
ENCROACHMENT PERMIT NO. 88-209
RECOMMENDATION:
Approve the application subject to:
1. An Encroachment Permit from the Public Works Department.
2. Execution of an agreement for non-standard improvements.
3. A survey of the property establishing the front property lines.
DISCUSSION:
Attached is a copy of a memorandum from the Parks, Beaches and
Recreation Commission approving the application of Rod Emery to encroach into
Ocean Boulevard adjacent to 2741 Ocean Boulevard, subject to the following
conditions:
1. That trees, plants and shrubs be maintained in such a manner as not to
obstruct public view from Ocean Boulevard.
2. That the large pine trees on the property be preserved and maintained.
If the application is approved by the City Council, the
recommendations of the Parks, Beaches & Recreation Commission will be
incorporated into the agreement for non-standard improvements.
The location is shown on the attached sketch.

SUBJECT: ENCROACHMENT REQUEST - 2741 OCEAN BLVD.
The Parks, Beaches and Recreation Commission at their meeting of
September 6, 1988, by motion, approved of the subject encroachment
request with the following conditions:
1. Trees, plants and shrubs be maintained in such a manner
as not to obstruct public view from Ocean Blvd.
2. The preservation and retention of the large Pine Trees
on the property be assured.
