PFAFF TO ENCROACH 12 TO 21 INCHES INTO THE PUBLIC RIGHT-OF-WAY AT 2411 VIA MARINA WITH A 24 TO 32 INCH HIGH CONCRETE BLOCK RETAINING WALL. (EP -88-195) RECOMMENDATION: If desired, approve the request, subject to: 1. Execution of an agreement for non-standard improvements. 2. That no fences or railing be constructed on the encroaching wall. DISCUSSION: Attached is a letter and drawing from Donald A. Pfaff stating the project background and requesting approval of an encroachment permit for an existing 24 to 32 inch high concrete block wall encroaching into the public right-of-way 12 to 21 inches at 2411 Via Marina, Newport Beach. The location is shown on the attached sketch. Council Policy L-6, "PRIVATE ENCROACHMENTS IN PUBLIC RIGHTS-OF-WAY" provides that private encroachments more than 3 feet in height, or encroaching more than 1 foot into the public right-of-way, requires the prior approval of the City Council. THE PROBLEM HAS BEEN EXPLAINED TO ME IN DETAIL FROM THE BUILDING DEPT POINT OF VIEW. THEY HAVE BEEN VERY HELPFULL IN UNDERSTANDING MY VIEW ALSO. THE BEST OPTION SEEMS TO BE THE REQUEST OF A ENCROACHMENT PERMIT WHICH IN THIS CASE NEEDS THE APPROVAL OF THE CITY COUNCIL. MY REQUEST IS TO KEEP THE EXISTING RETAINING WALL IN THE PUBLIC RIGHT OF WAY. THE STREET IS ONE WITHOUT SIDEWALKS OR STREET LIGHTS AND AND THE STRUCTURE IS BUILT TO A 10 FOOT PLUS SETBACK FROM THE CURB. I FEEL THE CITY WILL NOT BE MAKING ANY CHANGE TO THE STREET THAT WOULD MAKE IT NECESSARY TO REMOVE THIS STRUCTURE AT ANY TIME IN THE FUTURE. MY LOT SLOPES TO THE STREET AND MY FRONT YARD IS THE ONLY YARD MY HOME HAS. IT WAS NECESSARY TO CREATE A LEVEL YARD FOR MY FAMILY TO ENJOY. aZ PLEASE GRANT ME THE ENCROACHMENT PERMIT AT THIS TIME.
