F-16 TO: CITY COUNCIL APR 111988 APPROVED FROM: Public Works Department SUBJECT: REQUEST OF HARRY WESTOVER OF 2301 PACIFIC DRIVE TO CONSTRUCT PLANTERS, PATIOS, RETAINING WALLS AND STAIRS WITHIN THE PACIFIC DRIVE PARKWAY ADJACENT TO 2301 PACIFIC DRIVE. (PARCEL 1 OF PARCEL MAP 83-713) RECOMMENDATION: If desired: 1. Approve issuance of an encroachment permit for construction of non-standard improvements. 2. Approve the encroachment agreement; authorize the Mayor and the City Clerk to execute the agreement; and direct the City Clerk to have the agreement recorded with the Orange County Recorder. DISCUSSION: Harry Westover, the owner of 2301 Pacific Drive, is proposing to construct planters, low retaining walls, patios and stairs within the Pacific Drive Parkway. Pacific Drive is a narrow street with a parkway width of approximately 27'. Curb and sidewalk presently exist adjacent to the subject property with approximately 19' between the back of sidewalk to the property line. The property owner would like to construct a patio and planters in this area, however, small retaining wall planters and stairs are required as the property is located on a slope which slopes away from Pacific Drive. Prior approval of City Council is required for private structural improvements such as retaining walls, raised planters, etc., in public easements or rights-of-way. The encroachment agreement will allow construction of the retaining walls and stairs within the public right-of-way as approved by the Public Works Department. The property owner will be responsible for maintenance of the improve- ments and hold the City harmless of all liability for the non-standard improvements.
