SUBJECT: LICENSE AGREEMENT FOR CONSTRUCTION OF A PRIVATE DRAIN ACROSS
THE PUBLIC RIGHT -OF -WAY ADJACENT TO 930 MARINERS DRIVE
(RESUBDIVISION NO. 559).

RECOMMENDATIONS:
DISCUSSION:
1. Adopt a resolution approving a license agreement for private
storm drain improvements in the public right -of -way with Mr..
J. H. Handy, and authorizing the Mayor and City Clerk to
execute the agreement.
2. Authorize and direct the City Clerk to have the agreement
recorded with the Orange County Recorder.
Mr. J. H. Handy has proposed to construct a private storm drain
line across Mariners Drive in order to connect into an existing
public storm drain line. His building site lies below Mariners
Drive, and must therefore drain directly into the public storm
drain system.
The agreement will allow construction of the private storm drain
improvements as approved by the Public Works Department, and re-
quires that the property owner be responsible for maintenance and
restoration of those improvements.
