LEASE AGREEMENT
BETWEEN THE
CITY OF NEWPORT BEACH
AND THE
BALBOA PENINSULA POINT ASSOCIATION
(Property Easterly of "N" Street)
THIS LEASE AGREEMENT entered into this /2 day of
li.._..--:....;.t , 1969, by and between the CITY OF NEWPORT BEACH, a
municipal corporation, hereinafter called "City", and the BALBOA
PENINSULA POINT ASSOCIATION, a California non-profit corporation,
hereinafter called "Association":
RECITALS:
City is the owner of a certain parcel of land located
in the City of Newport Beach on the Balboa Peninsula at the foot
of "N" Street, which property has been leased to the Balboa
Peninsula Point Association by City pursuant to an agreement dated
November 28, 1949, which will expire on November 30, 1969. The
Association has constructed improvements on said property, and
has complied with all terms of the existing agreement. The
Association has requested that the City Council authorize an
extension of the present lease, and the City Council is willing
to do so on the basis of the following terms and conditions:
NOW, THEREFOI€,IT IS AGREED between the parties hereto
as follows:
1. TERM. City hereby leases to the Association all
that certain real property lying

for an indefinite term extending from year to year, subject to
termination at any time, without cause, by either party, said
termination to be effective 90 days from the date of mailing
written notice of cancellation.
2. USE. The Association agrees to use said land solely
for recreational purposes and not to permit any commercial use of
said land. However, the Association may charge its members a
small, reasonable annual fee for use of the land and improvements.
The Association further agrees to permit any person who is a perma-
nent or temporary resident of the Balboa peninsula area extending
easterly from Main Street to join the Association on identical
terms with other members without regard to race, creed, nationality
or whether they own, rent or lease their place of residence.
3. IMPROVEMENTS. The Association agrees that it shall
not make, erect, construct or otherwise place upon said land any
improvement, building, structure or permanent facility of any
kind, without first obtaining the written consent of the City.
The Association further agrees that all improvements of a permanent
nature which become affixed to the property shall become the
property of the City.
4. MAINTENANCE. The Association agrees to maintain
said land and all improvements thereon in good condition and
repair at all times during the term of this lease.
5. HOLD) HARMLESS. The Association agrees to indemnify
and hold harmless the City, its officers and employees against and
from any and all claims, demands, actions, judgments or liability
of every kind and nature arising out of or related to the
Association's occupation and use of said property, and the
Association shall reimburse the City for any costs and expenses
incurred by City in defending any such claim, demand or action,
including any attorneys' fees, court costs or other expenses
incurred by the City.

6. LIABILITY INSURANCE. The Association shall file
with the City Clerk, and shall, 'thereafter during the term of
the lease maintain in full force and effect, at its own expense,
a general comprehensive liability insurance policy which shall
insure the City, its officers and employees against liability in
the amount of $500,000 combined single limit per occurrence for
bodily injury and property damage. The policy shall name the
City, its officers and employees as additional insureds, and
shall contain a provision that a written notice of any cancella-
tion, modification or reduction in coverage of said policy shall
be delivered to the City Clerk thirty (30) days in advance of
the effective date thereof.
7. ASSIGNMENT. This lease shall not be subject to
assignment.
8. CANCELLATION OF EXISTING LEASE. The lease agreement
between the City and the Association dated November 28, 1949, is
hereby canceled as of the effective date of this agreement.

2. The Lessor City of Newport Beach, its officers, and employees are hereby declared to be additional insureds in the policy
described insofar as they may be held liable for injuries, deaths, or damage to property occuring in or about the leased
premises including negligence of the city and the company waives any right of contribution which it may have against any
other insurance carrier by the additional insureds.
INSURANCE REQUIREMENT
Lessee shall, at his own expense, take out and keep in force during the within tenancy, public liability insurance, in a company or
companies to be approved by the Lessor, to protect the City of Newport Beach, its officers and employees against any liability,
including negligence of the City, to any person incident to the use of, or resulting from injury to, or death of, any person occuring in,
or about the demised premises, in the amount of not less than $100,000.00 to insure against the claim of one person; in the amount of
not less than $300,000.00 against the claims of two or more persons resulting from any one accident; and $50,060.00 for damage to
property.
Said policies shall obligate the insurance carriers to notify the Newport Beach City Manager in writing, not less than fifteen (15) days
prior to the cancellation thereof, or any other changes affecting the coverage of the policies.
Lessee shall furnish as proof of public liability insurance, a fully executed copy of City form, "Certificate of Insurance for Lease of
City Property" and "City Property Endorsement." Lessee agrees that, if Lessee does not keep such insurance in full force and effect,
Lessor may take out insurance and pay the premiums thereon, and the repayment thereof shall be deemed to be additional rental.
This endorsement countersigned by an authorized representative of the Company or Organization becomes applicable endorsement

of the lease, rental or other agreement entered into between the insured as Lessee and the City of Newport Beach as Lessor.
The Company or Organization amends the policy described herein as follows:
1. If the policy is cancelled or changed so as to affect the coverages, at least fifteen (15) days prior written notice of such
cancellation or change will be sent to the Lessor, City of Newport Beach, c/o City Manager, 3300 Newport Boulevard,
Newport Beach, California 92660.
2. The Lessor City of Newport Beach, its officers, and employees are hereby declared to be additional insureds in the policy
described insofar as they may be held liable for injuries, deaths, or damage to property occuring in or about the leased
premises including negligence of the city and the company waives any right of contribution which it may have against any
other insurance carrier by the additional insureds.
INSURANCE REQUIREMENT
Lessee shall, at his own expense, take out and keep in force during the within tenancy, public liability insurance, in a company or
companies to be approved by the Lessor, to protect the City of Newport Beach, its officers and employees against any liability,
including negligence of the City, to any person incident to the use of, or resulting from injury to, or death of, any person occuring in,
or about the demised premises, in the amount of not less than $100,000.00 to insure against the claim of one person; in the amount of
not less than $300,000.00 against the claims of two or more persons resulting from any one accident; and $50,000.00 for damage to
property.
Said policies shall obligate the insurance carriers to notify the Newport Beach City Manager in writing, not less than fifteen (15) days
prior to the cancellation thereof, or any other changes affecting the coverage of the policies.
Lessee shall furnish as proof of public liability insurance, a fully executed copy of City form, "Certificate of Insurance for Lease of
City Property" and "City Property Endorsement." Lessee agrees that, if Lessee does not keep such insurance in full force and effect,
Lessor may take out insurance and pay the premiums thereon, and the repayment thereof shall be deemed to be additional rental.

OF NEt'PORT BEACH AUTHORIZING THE EXECUTION OF
A LEASE AGREEMZNT WITa THE BALBOA PENINSULA
POINT ASSOCIATION FOR BEACH PROPERTY EASTERLY
OF "N" STREET
WHEREAS, there has been presented to the City Council
of the City of Newport Beach an agreement between the City of
Newport Beach and the Balboa Peninsula Point Association for
the lease of the following legally described beach property
easterly of "N" Street in the City of Newport Beach, for an
indefinite term extending from year to year:
"Lot 43, Tract 756, City of Newport Beach,
County of Orange, State of California, as shown on
a map recorded in Book 23, pages 7 and 8, Miscellaneous
Maps, records of Orange County,"
and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED that said agreement for
the lease of the above described property is approved, and the
Mayor and City Clerk are hereby authorized and directed to
execute the same on behalf of the City of Newport Beach.

Honorable Gentlemen:
The Balboa Peninsula Point Association is presently leasing, for recre-
ational purposes only, a portion of the city property known as the 7M"
Street beach. The lease is presently due to expire on November 30, 1969..
For reasons outlined below, the Association hereby requests the City
Council to authorize the City Attorney to enter into negotiations to
renew the lease at this time for an additional lease period.
One of the principal uses of this property is to provide boat -launching
facilities for the residents immediately adjoining. To facilitate this
use, the Associationjhas spent capital funds to construct bulkheads and
floats. Within the last year, the Association has further improved. these
facilities and needs an extension of the lease in order to amortize the
cost of these capital improvements. In addition, the Association con-
templates continuous maintenance and whatever new capital improvement
which may be necessary in order to carry out the present program of
family boat -launching. The youth participation is expected to increase
with official.race status for the Point Association.
Without the boat -launching facilities, it would be necessary for the
residents on the Point to.travel through the heavily congested peninsula
traffic to commercial landings. Since there is not sufficient parking
at the Point location.to accommodate commercial launching, the entire•
project would have to be discontinued without the Point Association lease.
The Point Association has abided by the terms of the present lease and has
endeavored to secure as wide a participation of the facilities as possible.
An extension of said lease would not only serve the residents of the Point
area, but is in'the best interests of the City. The lease makes possible
a recreational area for the children and youth of the area without requiring
.City supervision.
We wish to thank the Council in advance for their consideration of this
proposal.

Subject: Renewal of "l" Street beach property lease to
Balboa Peninsula Point Association
The existing lease between the City and the Balboa Peninsula Point.
Association authorizes the use by the Association, for recreational
purposes, of a parcel of City -owned property approximately
12,000 square feet in area at the foot of "N" Street, on the
Balboa Peninsula. The existing lease is for a term of 20 years,
commencing on December 1, 1949, through November 30, 1969.
Balboa Peninsula Point Association sent a formal request to the
City Council for an extension of the lease in a letter dated
October 2, 1964, which is attached to this memorandum. The lease
has been re -drafted to pYovide for an indefinite extension from
year to year, subject to cancellation at any time by either party,
upon 90 days' written notice. Other changes in the language of the
lease are:
1. An increase in the required liability insurance protection to a
$500,000 combined single -limit coverage;
2. The existing lease provides that the leasedproperty may be used
by any person, whether or not a member of the Association, who
is permanently or temporarily a resident of the Balboa Peninsula
area of the City, extending easterly of "F" Street.
In the new lease this language has been changed to provide that
the Association will "...permit any person who is a permanent
or temporary resident of the Balboa Peninsula area extending
easterly from Main Street to join the Association on identical
terms with other members without regard torace, creed,
nationality, or whether they own, rent or lease their place of
residence.
The proposed lease has been reviewed with representatives of the
Association. It is my understanding that the language contained
therein is acceptable to them.
