HomeMy WebLinkAbout06/25/1990 Item F-3a;T 6 -Ty JUN 2 51990 VEA C _205f June 25, 1990 City Council Agenda Item No. --F-3 (n,) TO: MAYOR PLUMMER AND MEMBERS OF THE CITY COUNCIL From: City Negotiating Team SUBJECT: TENTATIVE AGREEMENT WITH THE NEWPORT BEACH CITY EMPLOYEES ASSOCIATION The following points have been ageed to in terms of a two year Memorandum of Understanding by both the negotiators for the Newport Beach City Employees Association and the City's negotiators. Final agreement is subject to ratification by the members of the Association and approval by the city Council. 1. The two year agreement contains language providing for reopeners on benchmark review, J-1 comparison review to ascertain that components of total compensation were properly compared, sick leave abuse, programs mandated by governmental agencies other than the City which may affect terms and conditions of employment, and items mutually agreed upon. 2. 1990-91 J-1 Total compensation increase of 9.0%. 3. The $400 cap will remain on medical coverage for the life of this M.O.U. (Subject to #1, above). 4. The City and NBCEA will jointly prepare a list of benchmarks and benchmark comparisons in Fullerton, Santa Ana, Huntington Beach, and Anaheim for incorporation into the MOU. 5. NBCEA will consent to phase in of highest year. Phase in to be in synch with Police, Fire, Marine, and Professional and Technical phase-in. An amortization schedule showing the percentage to be added each year will be incorporated into the MOU. 6. When an employee having five years of service with the City is on an approved disability leave of absence (up to a maximum of one-year), the City will pay one-third of the cost of the employee's insurance (health, life, and disability); for an employee with ten years of service the City will pay two- thirds of the cost; the City will pay the entire cost for an employee with fifteen or more years of service. ov 7. Night shift differential will be increased to $1.00/hr. for work after 5pm. 8 Insurance proposals will be referred to the Medical Advisory Committee. 9. Tuition reimbursement will be brought to 1990-91 costs of part-time status at UCI. 10. NBCEA will participate in Paid Leave Program on a voluntary basis with all new hires placed in the program. Open enrollment to be one-time only. Changes in enrollment subject to bargaining process. Understanding to be taken to NBCEA members is that it is a one-time only choice. Access to sick leave already booked will be liberalized. 11. Grievance procedure will remain as is for the life of M.O.U. 12. Labor Management Committee will remain the same in the Library. It will be restructured for City Hall and will meet quarterly rotating among department groups. 13. When a position is reclassified upward, the incumbent of the position being reclassified shall be reclassified with the position. If the position being reclassified has not been occupied by one individual for a period of one year, continuously prior to he reclassification, the reclassified position may be filled by recruitment. Unless, in the judgement of the department director, there are exceptional circumstances such recruitment shall be closed promotional. 14. City shall memorialize in MOU language concerning present Sunday pay program in Library. 15. In response for the trade on one floating holiday in 1990, the City agrees to 8 hour day holidays on Christmas Eve and New Year's Eve. 16. The City agrees to maintain, for the life of this agreement, the existing "experience and training" language in the job descriptions for the following positions: Management Analyst, Personnel Analyst, Assistant/ Associate Planner, Systems Analyst. 18. Drug testing program will be referred to an ad-hoc committee consisting of all employee associations and management. 19. There will be a consolidation of documents. 20. Remove "privlege" from the City's sick leave policy language. BACKGROUND: The City representatives and representatives of the recognized employee associations have been engaged in the meet and confer process, which is required by City policy and State law, since March of this year. This process has now resulted in six tentative agreements. These agreements have been developed within the limits of authority granted by the City Council. Attached are the agreement summaries and between the City of Newport Beach and the following employee associations: a. The Newport Beach City Employees Association b. The Newport Beach Employees League c. The Newport Beach Ocean Lifeguards Association d. The Newport Beach Firefighters Association e.
