June 3, 1985 BY THE CITY COUNCIL T0: CITY COUNCIL CITY Of NEWPORT BEACH FROM: CITY MEET AND CONFER NEGOTIATING TEAM JUN 10 1IQ85 SUBJECT: NEWPORT BEACH FIREFIGHTERS ASSOCIATION NEGOTATIONS APPROVED The City Meet and Confer Team and the representatives of the Firefighters Association have met six times in an attempt to arrive at a Memorandum of Understanding for the 1985-86 fiscal year. On Monday, June 3, 1985, the City made its last and final offer. This offer would do the following: 1. Provide the Firefighters with a 4.5% total compensation increase, which would translate into a salary increase of 5.3%. 2. Vision care would be added to the existing indemnity health plan. 3. Standby pay for Firefighters on call for court would be increased from the present one hour for eight hours of standby time to four hours for eight. 4. A physical in accord with that recommended by both OSHA and CAL -OSHA for employees using breathing apparatus will be provided at a cost of approximately $68 per employee outside of J-1 total compensation. 5. The bereavement leave definition will be tightened to apply only in the case of terminal illness or death, no change will be made in the relationships defined in the definition. 6. Negotiations will be reopened to discuss wages and hours if required under the Fair Labor Standards Act implementation. The Firefighters appear to have accepted all items except Number 1. Fire- fighters contend that the J-1 Policy should compare the Fire Department to only other Fire Departments and not on a city-wide basis. As a result of this, the Firefighters have informed the City Negotiating Team that they are at impasse and will present their case to the City Council. )JgnPhart Principal City Negotiator �V + • pmt e s. The Council agreed to the extent thatithe negotiating tea was sent back to the table with new direction.4 You also indicate to us that the manner of applying a formula to or the implementation of the "J-1" policy would be discussed between us and the formula issue resolved before the next negotiating period. We believed you. We took you at your word. To show our faith in that word we chose not to renew our attorney's contract and we expressed a willingness to sit down at anytime for discussion. We went back to the table and ultimately signed. We waited for dialogue on "J-1". When the next negotiating period began to near, I wrote you a letter dated January 7, 1985, indicating again our feelings. I received no answer. I wrote again on February 14, 1985, again expressing our concern and urging that this issue be discussed. Again, I received no answer, at least directly. I heard that an answer was coming and after requesting a copy of that answer, I was handed on April 5, 1985, a xerox copy of a two sentence reply thanking me 1) for my cooperative spirit and, 2) agreeing that a good employer/employee relationship exists in Newport - a subject not even addressed in the letter. I, as the Association President, feel that I and the Association have been treated with a total lack of regard and courtesy. The issues regarding "J-1" are still here. It has been applied again, as it was last year. You have not yet met with us in an effort to resolve or understand our point of view. RO. You, by not meeting us on common ground as you indicated, have forced us again to that regrettable position - impasse. We again ask that you meet with us and give this issue due consideration. Allow us to, at the very least, present to you our case. Do that and we can, at least for the time being, remove ourselves from this position.
