Honorable Mayor T and Members of the City Council FROM: Duane K. Munson RE: Revision in Compensation Reporting to the Public Employees Retirement System (PERS). RECOMMENDATION: Approve the attached resolutions to modify the methods of of compensation reporting to PERS, for the following defined employee work groups: Newport Beach Police Management Association, Newport Beach Police Employees Association, Newport Beach Fire Management Association, Newport Beach Firefighters Association, Newport Beach Professional and Technical Employees Association, Newport Beach City Employees Association, Newport Beach Employees League, Newport Beach Marine Safety Officers Association, and Key and Management. DISCUSSION: The attached resolutions are being presented to you in response to the requirements contained in the new regulations promulgated by PERS, in circular letter Number 200-256. These regulations, issued by PERS, were motivated by the passage of SB 53, which is a bill that was passed by the California State Legislature last Summer directed at reforming compensation reporting by member agencies to the State's retirement system. Staff has carefully examined all available options and is recommending this option, because it has the least potential for raising the cost over our present reporting methods, and is also the least complicated option for the City to adopt. 0 0 RESOLUTION NO. 94-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH REVISING THE COMPENSATION REPORTING METHODS TO THE PUBLIC EMPLOYEES RETIREMENT SYSTEM (PERS). WHEREAS, The City of Newport Beach has the authority to implement Government Code Section 20023 (C) (4) pursuant to Section 20615; WHEREAS, City of Newport Beach has a labor policy or agreement which specifically provides for the inclusion of normal member contributions paid by the employer on behalf of the members: WHEREAS, one of the steps in the procedures to implement this section is the adoption by the governing body of the City of Newport Beach of a Resolution giving notice of its intention to commence reporting the value of employer paid member contributions (EPMC) as compensation for all members of a group or class; WHEREAS, the following is a statement of the proposed change In reporting compensation to PERS: The City of Newport Beach elects to pay 9% of the normal member contributions as employer paid member contributions (EPMC) and report same percent to PERS as compensation. This benefit shall apply to all employees of the Newport Beach Firefighters Association. The effective date of this Resolution shall be July 1, 1994. NOW, THEREFORE, BE IT RESOLVED that the governing body of the City of Newport Beach shall implement Government Code Section 20023 (C) (4) pursuant to Section 20615 by paying the normal member contributions as employer paid member contributions and reporting the same percent to PERS as compensation for all employees of Newport Beach Firefighters Association.
