SUBJECT: AMENDMENT OF MEMORANDUM OF UNDERSTANDING

RECOMMENDATION: Adopt Resolution No. approving an amendment
to the existing Memorandum of Understanding with the Newport Beach Ocean
Lifeguard Association.
DISCUSSION: In May, 1973, the City negotiated a two -year contract
with the Newport Beach Ocean Lifeguard Association which provided a
6% salary increase in July, 1973, and 6% increase in July, 1974. While
it was felt at the time the agreement was signed that the settlement was
fair and equitable to both parties, recent salary adjustments in other
jurisdictions during the interim period made a re- evaluation of that
portion of the contract necessary in order that salaries could be main-
tained at the level prescribed by Council Policy J -1. Therefore, negotia-
tions were reopened this month with the Representatives of the Lifeguard
Association and the City Representative agreed to recommend to the Council
that the existing contract be amended to provide:
1. A 3% increase in salary effective in January, 1975,
in addition to the 6% increase in July, 1974;
2. Inclusion of the members of the Lifeguard Association
in the City's Modified Health Insurance Plan recently granted
to all other employee groups.
The cost of the additional 3% salary increase in January, 1975, is estimated
to be $1,460.00 and the Health Insurance modification cost is estimated at
$545.00 for Fiscal Year 1974 -75.
I recommend that the Council approve these two changes to the contract to
insure that the employees affected are not penalized financially because of
events which could not be foreseen a year ago.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE AGREEMENTS NEGOTIATED
BY REPRESENTATIVES OF THE FIREFIGHTERS ASSOCIATION,
THE POLICE EMPLOYEES ASSOCIATION, AND THE CITY REPRE-
SENTATIVE.
WHEREAS, Resolution No. 7173 of the City Council
of the City of Newport Beach provides that the City Representative
and Representatives of the recognized Employee Associations will
meet and confer in good faith regarding matters within the scope
of representation; and
WHEREAS, the City Representative and Representatives
of the recognized Employee Associations have met and have agreed
on those matters within the authority of such representatives; and
WHEREAS, the City Representative and Representatives
of the recognized Employee Associations have jointly recommended
approval of these agreements by the City Council.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach does hereby approve the agreements
reached and directs that the changes recommended by the agreements
be placed into effect on July 6, 1974.

SUBJECT: TRANSMITTAL OF MEMORANDA OF UNDERSTANDING
RECOMMENDATION: Adopt Resolution No. approving the agreements
reached Newport Beach Firefighters Association and the Newport
Beach Police Employees Association.
DISCUSSION: Forwarded herewith for your consideration are the signed
MemoranJa— of Understanding negotiated with representatives of the
Newport Beach Firefighters Association and the Newport Beach Police
Employees Association. The negotiations were conducted in accordance
with Sections 3500 -3510 of the California Government Code and the City
of Newport Beach Employee - Employer Relations Resolution (Resolution 7173).
As required, this agreement is now presented to the City Council for
final determination.
Outlined below are the major areas covered by the agreements and the costs
of each:
A. SALARIES
Police: Police employees were granted increases ranging from
8 - 10% on July 6, 1974, with an additional 5% effective on
April 12, 1975. Since the increase was made in two steps, the
overall average increase for the year is 9.18% at a cost of
$201,085.00.
Fire: Fire employees were granted an 8% increase effective
July 6, 1974, and an additional 5% on March 29, 1975. The
two step increase averages 9.25% for the fiscal year at a
cost of $112,000.00.

B. RETIREMENT

The salary increases will produce a proportionate increase
in the retirement costs to the City of approximately $29,000.00
for Fiscal Year 1974 -75.
C. HEALTH INSURANCE
The City's Health Insurance Plan was modified to provide a
reduced deductible, higher maximum major medical coverage,
and a limitation on out -of- pocket costs to the employee.
The maternity benefit was deleted. Cost of these modifi-
cations is estimated at $19,000.00 per year.
D. NIGHT DIFFERENTIAL PAY
An increase from $.15 to $.25 per hour in night differential
pay was granted to those clerical employees of the Police
Department who regularly work the night and morning watch.
Cost is estimated at $1,500.00 for Fiscal Year 1974 -75.
E. UNIFORM ALLOWANCE
An increase in the uniform allowance of $25.00 per year per
man was granted to members of the Firefighters Association.
Cost of this item is estimated at $2,275.00 for Fiscal Year
1974 -75.
F. SCHOLASTIC ACHIEVEMENT PLAN
Agreement was reached on funding of a Modified Scholastic
Achievement Plan for the Police Association in the amount
of $45,000.00 for Fiscal Year 1974 -75, an increase of $15,000.00
over Fiscal Year 1973 -74.
In summary, the total cost of the salary and benefit agreements for these
two groups of employees in Fiscal Year 1974 -75 is as follows:
Police $248,585 (9.9 %)
Fire $131,743 (9.6 %)
It is my opinion that the agreements reached represent a fair and equitable
settlement for the employees and the City and I recommend your approval.
