A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, REESTABLISHING
THE NEWPORT BEACH CITY COUNCIL HOMELESS AD
HOC COMMITTEE
WHEREAS, on March 26, 2019, the City Council adopted Resolution No. 2019-
25 establishing a City Council/Citizens' Committee known as the Newport Beach
Homeless Task Force ("Task Force") to study the impacts of homelessness on the City
of Newport Beach ("City") and develop solutions to end homelessness;
WHEREAS, on May 14, 2019, the City Council adopted Resolution No. 2019-42,
increasing the membership of the Committee to three (3) councilmembers and seven
(7) residents;
WHEREAS, on September 14, 2019, the City Council adopted Resolution No.
2019-85 declaring a shelter crisis pursuant to Senate Bill 850 as codified in California
Government Code Section 8698.2;
WHEREAS, as a result, on November 12, 2019, the Task Force recommended
that the City Council reconstitute the character, membership, and purpose to form a City
Council ad hoc committee ("Committee");
WHEREAS, on November 19, 2019, the City Council adopted Resolution No.
2019-100 reconstituting the character, membership, and purpose of the Committee;
WHEREAS, pursuant to Resolution 2019-100 the Committee expired on
December 31, 2020 without making a recommendation to the City Council;
WHEREAS, in the interim, the City has significantly expanded services to
individuals experiencing homeless;
WHEREAS, at the January 29, 2022 City Council Planning Special Meeting, the
City Council expressed interest in evaluating whether the City's existing programs
adequately serve individuals experiencing homeless within Newport Beach particularly
in the wake of COVID-19; and
WHEREAS, the City wishes to reestablish the Committee.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:

Section 1: The Committee shall be comprised of three (3) councilmembers.
Council Member Avery, Council Member Brenner, and Council Member O'Neill shall
serve as members of the Committee. The term of the appointed members of the
Committee shall be indefinite pending City Council action or expiration of the Committee
as set forth in this resolution.
Section 2: The sole purpose and responsibility of the Committee shall be tc
evaluate whether the City's established contract services, including but not limited to,
City Net, Costa Mesa Temporary Bridge Shelter, Be Well OC Mobile Crisis Unit,
Permanent Supportive Housing and/or Trellis International Community Impact Team
adequately serve individuals experiencing homeless within Newport Beach.
Section 3: The Committee shall function as an ad hoc committee and shall not
be subject to the Brown Act.
Section 4: The Committee shall expire upon making its recommendations to
the entire City Council, at a noticed public meeting of the City Council, or December 31,
2022, whichever occurs first.
Section 5: If any section, subsection, sentence, clause or phrase of this
resolution is for any reason held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The
City Council hereby declares that it would have passed this resolution and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 6: The recitals provided in this resolution are true and correct and are
incorporated into the substantive portion of this resolution.
Section 7: The City Council finds the adoption of this resolution is not subject
to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2)
(the activity will not result in a direct or reasonably foreseeable indirect physical change
in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6,
Chapter 3, because it has no potential for resulting in physical change to the
environment, directly or indirectly.

Section 8: This resolution shall take effect immediately upon its adoption by
the City Council, and the City Clerk shall certify the vote adopting this resolution.
