HomeMy WebLinkAbout1497 - RECOMMEND APPROVAL OF CA_ CHAPTER 20.80 AND CHAPTER 20.03RESOLUTION NO. 1497 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH RECOMMENDING APPROVAL TO THE CITY COUNCIL OF AN AMENDMENT TO CHAPTER 20.80 AND CHAPTER 20.03 OF TITLE 20 OF THE MUNICIPAL CODE TO UPDATE REGULATIONS FOR SERVICE STATIONS AND TO ALLOW THE CO- DEVELOPMENT OF CONVENIENCE MARKETS [AMENDMENT 885] AND THE ADOPTION OF A SET OF DESIGN GUIDELINES FOR SERVICE STATIONS WHEREAS, current zoning regulations for service stations have not been updated since their adoption in 1972; and WHEREAS, that due to the specificity of the current regulations, a number of common service station activities are in violation the Zoning Code; and WHEREAS, the current property development regulations are not consistent with contemporary service station development; and WHEREAS, current zoning regulations preclude the development of convenience markets in conjunction with service stations; and WHEREAS, the development of these types of service stations under appropriate land use and property development regulations would provide the City of Newport Beach with additional commercial services, employment opportunities and revenues; and WHEREAS, current zoning regulations need to be revised in order to permit the development of these types of service stations and to bring the land use and property development regulations up to date; and WHEREAS, that a set of design guidelines is needed to review and evaluate the design of service stations to insure consistency with the City's policies relating to visual quality, community character, and the protection of adjacent development and land uses; and WHEREAS, on March 18, 1999 and April 8, 1999, the Planning Commission of the City of Newport Beach held public hearings regarding Amendment 885; and WHEREAS, the public was duly noticed of the public hearing; and WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the proposed amendment is categorically exempt under Class 5, minor alterations in land use limitations. NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Newport Beach does hereby recommend that the City Council of the City of Newport Beach approve Amendment No. 885 to revise Chapter 20.80 and Chapter 20.03 of Title 20 of the Municipal Code to read as provided in attached Exhibit "A." BE IT FURTHER RESOLVED, that the Planning Commission of the City of Newport Beach does hereby recommend that the City Council of the City of Newport Beach adopt a set of design guidelines for service stations provided in attached Exhibit `B." ADOPTED this 8th day of April, 1999, by the following vote, to wit: AYES Fuller, Ashley, Selich, Gifford, Kranzley and Hoglund NOES None ABSENT Tucker BY Ed and Selich, Chairman A. Fuller, Secretary
