A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF NEWPORT BEACH RECOMMENDING APPROVAL
TO THE CITY COUNCIL OF AN AMENDMENT TO TITLE 15
OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING
TO THE TRAFFIC PHASING ORDINANCE [AMENDMENT 8641
WHEREAS, in 1978 the City Council of the City of Newport Beach adopted Chapter 15.40
of the Newport Beach Municipal Code, the Traffic Phasing Ordinance; and
WHEREAS, the Traffic Phasing Ordinance has been amended by the City Council, after
receiving a recommendation of the Planning Commission, four times since its adoption; and
WHEREAS, the City Attorney of the City of Newport Beach has advised that judicial
decisions rendered subsequent to the adoption of the Ordinance have made certain aspects of it
vulnerable to a legal challenge; and
WHEREAS, City staff also identified minor operational problems associated with the
administration of the provisions of the Ordinance; and
WHEREAS, a committee of City Councilmembers, Planning Commissioners, Newport
Harbor Chamber of Commerce representatives, Building Industry Association representatives, and
SPON representatives met to discuss and recommend changes to the Traffic Phasing Ordinance; and
WHEREAS, the draft Ordinance revisions were also reviewed by the City's Environmental
Quality Affairs Committee and Economic Development Committee; and
WHEREAS, presentations of the draft Ordinance revisions were made to a number of
community groups and interested parties; and
WHEREAS, the proposed changes are considered to be the minimum necessary to resolve
legal and operational issues of the Ordinance; and

WHEREAS, the public was duly noticed of the public hearing of the Planning Commission;
WHEREAS, pursuant to the California Environmental Quality Act, it has been determined
that the proposed amendment is categorically exempt under Class 5, Minor Changes in Land Use
Regulations.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of
Newport Beach does hereby recommend that the City Council of the City of Newport Beach adopt
an amendment to Title 15 of the Newport Beach Municipal Code to revise the Traffic Phasing
Ordinance as provided in Exhibit "A."
