HomeMy WebLinkAbout1461 - RECOMMEND APPROVAL TO AMEND KOLL CENTER PC DISTRICT REGULATIONSRESOLUTION NO.1461 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF AMENDMENT NO. 867, AMENDING THE KOLL CENTER NEWPORT PLANNED COMMUNITY DEVELOPMENT STANDARDS TO INCREASE THE PERMITTED HEIGHT WITHIN LIGHT INDUSTRIAL SITE 1, FROM 75 FEET TO 90 FEET FOR A SINGLE VERTICAL COLUMN. (PLANNING COMMISSION AMENDMENT NO. 867) WHEREAS, as part of the development and implementation of the Newport Beach General Plan the Land Use Element has been prepared; and WHEREAS, Section 20.35.050 of the Newport Beach Municipal Code provides that amendments to a Planned Community Development Plan must be approved by the Planning Commission setting forth full particulars of the amendment; and WHEREAS, the Newport Beach Municipal Code provides specific procedures for the implementation of Planned Community zoning for properties within the City of Newport Beach; and WHEREAS, an amendment to the Koll Center Newport Planned Community is necessary in order to allow increased height on the subject property; and WHEREAS, the proposed change in the height limit from 75 feet to 90 feet for an air separation column only, within Light Industrial Site 1, is compatible with the height of surrounding office buildings since it will allow replacement of existing equipment of similar function; and WHEREAS, the project has been determined to be Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 5 (Minor Alterations in Land Use Limitations). NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Newport Beach does hereby recommend that the City Council approve Amendment No. 867 to change the height limit of "Light Industrial Site 1" of the Koll Center Newport Planned Community District, to increase the height limit from 75 feet to 90 feet for a single air separation column, not to exceed the height limits set by the Federal Aviation Authority and to amend the Koll Center Newport Planned Community District Regulations Part I, Section IV C to read as follows: C. Building Height Building heights of structures shall be limited to a height e€ seventy-five(75)feet. The height of a single vertical column (15 feet wide by 15 feet deep) associated with an Air Separation Plant (the function is to extract gas, i.e., nitrogen, oxygen, etc., from air), which supports on -site manufacturing activities, shall be limited to ninety (90) feet above ground level and shall in no way exceed the height limits set by the Federal Aviation Authority for Orange County Airport. Additionally, this vertical column shall be set back a minimum of 650 feet from Jamboree Road and 780 feet from Birch Street (property lines). The facility shall be limited to one column on site, unless otherwise approved in coniunction with a use permit approved by the Planning Commission for the relocation or replacement of the air separation column with a new column.
