HomeMy WebLinkAbout1465 - RECOMMEND APPROVAL AMENDMENT TO RECLASSIFY_1800-06 WEST BALBOA BLVD TO RSC DISTRICTRESOLUTION NO. 1465 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH RECOMMENDING APPROVAL TO THE CITY COUNCIL OF AN AMENDMENT TO RECLASSIFY PROPERTY LOCATED AT 1800 -06 WEST BALBOA BOULEVARD FROM THE TWO FAMILY RESIDENTIAL DISTRICT TO THE RETAIL AND SERVICE COMMERCIAL DISTRICT AND TO AMEND THE HEIGHT LIMITATION ZONE MAP TO PLACE THE SUBJECT PROPERTY INTO THE 26/35 HEIGHT LIMITATION ZONE [AMENDMENT 8711 WHEREAS, the Planning Commission has recommended to the City Council of the City of Newport Beach the approval of General Plan Amendment 98 -1 (A) and Local Coastal Program Land Use Plan Amendment Number 50 which would change the land use designation of the subject property from Two Family Residential to Retail and Service Commercial; and WHEREAS, that the proposed reclassification of the subject property from the Two Family Residential •(R -2) District to the Retail and Service Commercial (RSC) District is necessary to implement the proposed land use changes; and WHEREAS, the Zoning Code requires that the 26/35 Height Limitation Zone shall apply to all zoning districts, other than R -1, R -1.5, R -2 and MFR, within the area known as the Shoreline Height Limitation Zone; and WHEREAS, on April 9, 1998, the Planning Commission of the City of Newport Beach held a public hearing for Amendment 871; and WHEREAS, the public was duly noticed of the public hearing; and WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the proposed amendment is categorically exempt under Class 1, existing facilities. NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Newport Beach does hereby recommend that the City Council of the City of Newport Beach approve Amendment 871 to amend Districting Map Number 9 to reclassify the property identified in Exhibit "A" from to the Two Family Residential (R -2 District) to the Retail and Service Commercial (RSC) District as depicted in Exhibit `B." BE IT FURTHER RESOLVED, that the Planning Commission of the City of Newport Beach does hereby recommend that the City Council of the City of Newport Beach amend the City of Newport Beach Height Limitation Zone Map to place the property identified in Exhibit "A" in the 26/35 Height Limitation Zone as depicted in Exhibit "C." BE IT FURTHER RESOLVED, that the recommendation of approval by Planning Commission is contingent upon the approval of General Plan Amendment 98 -1 (A) and Local Coastal Program Land Use Plan Amendment Number 50 by the City Council of the City of Newport Beach.
