A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF NEWPORT BEACH APPROVING
AMENDMENT NO. 844 OF TITLE 20 OF THE
MUNICIPAL CODE SO AS TO STIPULATE THAT IF
AN OUTDOOR DINING AREA IS TO BE LOCATED
ON A PUBLIC SIDEWALK, AN ACCESSORY
OUTDOOR DINING PERMIT SHALL NOT BECOME
EFFECTIVE UNTIL A SIDEWALK CAFE LICENSE
ENCROACHMENT PERMIT HAS BEEN ISSUED
WHEREAS, Chapter 20.72 of Title 20 of the Newport Beach Municipal Code
currently provides for the issuance of Accessory Outdoor Dining permits subject to
certain findings and requirements; and
WHEREAS, Chapter 13.18 of the Municipal Code allows the Public Works
Director to issue Sidewalk Cafe License Encroachment Permits subject to certain
requirements; and
WHEREAS, the proposed amendment would clarify existing policy by stipulating
that if an outdoor dining area is to be located on a public sidewalk, an Accessory Outdoor
Dining permit shall not become effective until an applicant has obtained a valid Sidewalk
Cafe License Encroachment Permit pursuant to Chapter 13.18 of the Municipal Code;
and
WHEREAS, on March 21, 1996, the Planning Commission of the City of
Newport Beach held a public hearing regarding Amendment 844; and
WHEREAS, the public was duly noticed of the public hearing; and
WHEREAS, pursuant to the California Environmental Quality Act, it has been
determined that the proposed amendment is categorically exempt under Class 5, minor
alterations in land use limitations.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the
City of Newport Beach does hereby approve Amendment No. 844 to amend Section
20.72.018 of the Newport Beach Municipal Code by adding a new Section 20.72.018 (F)
to read as follows:
F. In the event that the proposed outdoor dining area is located
If
on a public sidewalk, an Accessory Outdoor Dining permit shall not become effective
until the applicant has obtained a valid Sidewalk Cafe License Encroachment Permit
pursuant to Chapter 13.18 of this Code.
