SUBJECT: STORM DRAIN EASEMENTS IN TRACT 1218
(From 15th Street to Dover Drive, Adjacent to Newport Harbor High School)
RECOMMENDATIONS:
Adopt a resolution accepting the offer of dedication of storm
drain easements shown on the map of Tract 1218, as follows:
(a) A 20-foot wide storm drain easement over the rear of
Lots 1 through 18 inclusive;
(b) A 20=foot wide storm drain easement over -the southerly
side of Lot 148;
(c) A 10-foot wide storm drain easement with its centerline
on the common line between Lots 9 and 10.
DISCUSSION:
The -map of Tract 1218, the area known as Cliffhaven, was recorded prior to
annexation to the city. The subdividers showed the subject storm drain easements on
the m&p. The acceptance clause signed on behalf of the Board of -Supervisors did not
specifically mention the storm drain Easements.
The Public Works Department has been working for a number of years in an
effort to have the 15th Street storm drain approved as a sub -regional project to be.
constructed by the Orange County Flood Control District. There'is now a good possib-
ility that the District will construct the storm drain in the 1971-72 fiscal year.
The drain will extend from Dover Drive up through the.easements to 15th
Street, and in 15th Street to Irvine Avenue. A sketch showing the easement and drain
is attacfred..
Section 11616 of the Subdivision Map Act provides in substance that at the
time of final map approval, the governing body may reject any offers of dedication and
that such offers shall then remain open. It is the opinion of -the City Attorney that
the City Council as governing body, may at this time accept the offer of dedication.
If the Orange County Flood Control District builds the *storm .drain, the city
may be required to convey its easement to the district. If the district does not build
the drain, the city will become responsible for maintenance of the existing natural
drainage course. To date little maintenance has been necessary..
