F-13 TO: CITY COUNCIL FROM: Public Works Department SUBJECT: ACQUISITION OF 3404 BALBOA BOULEVARD (A.P. 423-351-12) RECOMMENDATIONS: F THE CiT i COUNCIL CITY OF NEWPORT BEACH AUG 12 1985 1. Authorize the purchase of 3404 Balboa Boulevard APPROVED $150,000. 2. Authorize the acceptance of a grant deed for 3404 Balboa Boulevard from Terry A°. and Aida 0. McKelvey. DISCUSSION: On November 28, 1983, the City Council certified the Final EIR and directed staff to apply for AHFP funding necessary to acquire right of way to widen Balboa Boulevard from 33rd Street to 44th Street Implementation .of the project requires the acquisition of six parcels. The current schedule calls for the purchase of the six parcels over a two-year period followed by a one-year construction period. The purchase of this parcel is programmed for the second -year phase of right-of-way acquisition. Mr. George Hamilton Jones, MAI, was retained to appraise all six properties. He completed the appraisal on November 20, 1984, and concluded that the fair market value of the subject parcel was $150,000 as of September 5, 1984. This parcel is unique when compared to all other parcels previously purchased. The property fronts 30 feet on Balboa Boulevard and is 75 feet deep. As only 25 feet are required to widen the roadway, the appraiser also concluded that just compensation for the partial take was $6.6,670. Both offers were pre- sented to the owners. However, the partial -take offer was rejected based on the fact that the acquisition of the 25-foot strip of land would require total demolition of the single residence structure. Mr. and Mrs. McKelvey have occupied the dwelling over 90 days, making them eligible for relocation benefits if they move from the property at the City's request. These benefits could be as much as $15,000 plus moving expenses. At this time, the McKelvey's wish to remain in the dwelling and rent the house from the City at a fair market value. It is recommended that the City purchase 3404 Balboa Boulevard for the appraised fair market value of $150,000. Funds have been budgeted using Gas Tax monies and AHFP funding for the acquis- tion of parcels along Balboa Boulevard. AHFP funding, however, will August 12, 1985 Subject: Acquisition of 3404 Balboa Boulevard (A.P. 423-351-12) Page 2 only be available for the appraised partial take The remainder pro- perty will have a 30-foot frontage on Balboa Boulevard with a 50-foot depth along a side alley. The remainder of the parcel can be con- sidered a legally buildable lot and could be sold at an auction. The attached Exhibit A shows the subject property, as well as the seventeen parcels that the City has already acquired for the widening of Balboa Boulevard. The acquisition of this parcel leaves one parcel to be acquired between 33rd Street and 44th Street. Benjamin B.
